Dear Sir or Madam,

I note that your Annual Report states that "The Wales Office
complies with the requirements of the Civil Service Order in
Council 1995, when recruiting its staff. Every individual appointed
is selected on merit on the basis
of fair and open competition, apart from cases where exceptions are
permitted under articles
6 and 7 of the Order."

Under the Freedom of Information Act 2000 I would like to know how
many Wales Office staff in the past 3 years have been recruited or
promoted without fair and open competition, and into which posts. I
further request any correspondence, internal or otherwise, relating
to the appointment of these staff.

I do not consider that this information would fall into any of the
exemptions under the Act.

Dear Mr Cogbill,

I am writing to request an internal review of Wales Office /
Swyddfa Cymru's handling of my FOI request 'recruitment'.

I refer to your response to my request for information under the
Freedom of Information Act (your ref 09FOI270). I am unhappy with
your response for the following reasons.

I believe you have deliberately misinterpreted and ignored parts of
my question in order to avoid answering truthfully and to withhold
information.

For the avoidance of doubt I wish to receive information relating
to any period of promotion, either temporary or otherwise for all
members of Wales Office staff, whether considered permanent or
otherwise for the past 6 years (which I have extended from the 3
years I originally requested because of your failure to answer
truthfully). I wish to know the number of staff on temporary
promotion over that time period, the length of the promotion, the
roles they were in and the justification for the temporary
promotion. I know for a fact that it is a lot more than the three
cases you have referred to in your response.

I also wish to know about any permanent or substantive promotion
made without open and fair competition to that specific post, and
the justification for that promotion.

I note that you ignored my request for copies of any documents
relating to promotions, and repeat this request again in line with
the above.

I would also like to know when I will receive a response to this
given that you failed to meet the legally enforced deadline of the
Freedom of Information Act following my initial request.

I consider your organisation in breach of the law in relation to my
requests and further failure to provide the information I have
legally requested will result in a formal complaint being made to
the Information Commissioner.

I trust this makes my position clear and that you will now furnish
me with the correct information.

Dear Mr Cogbill,

Thank you for your response to my request for an internal review.

I do not believe that I need say any more than my last letter, but
I will tell you that I have seen dated organisation charts which
show many staff on so-called temporary promotion, some for a number
of years. So your office's response outlining just three posts is
clearly incorrect.

No mention was made in your office's response to my request for all
correspondence relating to these promotions which I consider to be
another failure under the Act.

I look forward to receiving your response.
