Dear Sir or Madam,

In March 2005, the HSE published a report with recommendations
following the Glenridding school trip tragedy.

The HSE investigation of the tragedy said that there were lessons
to be learned both by those who lead educational visits to high
hazard environments and by those involved in their management. The
HSE said it was important that these lessons should be widely
disseminated.

Please can I see copies of anything that you as an authority sent
to schools on this subject?

I made an FOI request to your authority on 24 August 2008.

You replied on the 26 August and told me that you had outsourced
your education function to the Learning Trust. You further told me
that you had forwarded my request to Matt Cranton at the Learning
Trust.

This request is now overdue; by law I should have received a
response by 23 September. Please could you ensure that I receive a
response as soon as possible.

Freedom of Information Request - Recommendations to Schools following the HSE Report on the Glenridding Tragedy

Thank you for your email of 24 August 2008, which was passed to me by London Borough of Hackney. This was originally sent to an incorrect email address. I acknowledge receipt of your request for information. I should firstly point out that The Learning Trust is not a "public authority" under the terms of the Freedom of Information Act 2000 ("the Act").

The Learning Trust is a private company limited by guarantee which carries out the majority of the functions of Hackney Council as a Local Education Authority under a Contract entered into pursuant to a Direction of the Secretary of State dated 31st July 2002.

The Learning Trust was incorporated in May 2002 for the sole purpose of carrying out the functions transferred pursuant to that Direction from 1st August 2002. There is a power under Section 5 of the Act for the Secretary of State to designate a company such as The Learning Trust as a public authority but to date that power has not been exercised in respect of The Learning Trust.

Consequently, The Learning Trust is not bound by the provisions of the Freedom of Information Act. However as a body exercising public functions The Learning Trust is committed to doing so openly and transparently. The Learning Trust has developed a policy which, so far as its constitution allows, complies with the provisions of the Act.

With regard to your request, please find attached a copy of the 2004 version of the Educational Visits section of The Learning Trust's Health and Safety Manual. This has not fully incorporated the HSE recommendations following the Glenridding tragedy. However, The Learning Trust is in the final stages of redrafting the Health and Safety Manual, including this section. This is expected to be completed by the end of this month. We will be happy to provide you with a copy of the finalised updated section on request.
