Dear Syed Faghurudeen

Thank you for your e mails dated 01/04/2009 concerning the above matter.

Your initial enquiry is a general enquiry, not an FOI request, as you
are asking about the status of your application. In addition, any
information would subsequently be published on the website and so it is
not appropriate for enquiries of a personal nature.

You should therefore direct your enquiries to the Immigration Enquiry
Bureau (IEB) and I have enclosed the details for your reference.
Further information can be found on the UKBA website.

Dear Sir or Madam,

I wish to state tht I don't ask the status and request you to
please not to misunderstand in this matter.

I got refusal letter(Result). Now I request you to let me inform me
the reason for refusal of my application under what section and as
per the vice consul's statement to FOC directorate that I am not
eligible for BOC and now I need clarification with full details how
I am not eligible?

Again I confirm that my request depends on FOI only requesting to
reveal the particulars about my refusal. Because I got the
confirmation of eligiblity that I am eligible for BOC from UKBA and
I sent it to Fco Directorate as well as British High
Commission,Malaysia.

I request you to not redirect my case to another and defenetly it
falls on Freedom of Information Request.

I hope you understand this time and do the needful sir.

As you are the authority you should reply me with in 20 days and
not to say goodbye please.

Yours sincerely,

Syed Faghurudeen

17 July 2009

Dear Sir or Madam,

I herewith inform you that FCO stated on 31/03/2009 that my BOC
application was refused due to my ineligible because of
birth, legislature at time and ancestral link with UK.But after I
sent the UKBA reply confirming eligibility now it changed the
decision time to time.Is it any provision to change decision as
like as.Now FCO told that I didn't produce sufficient documents to
BHC,Malaysia though I produced all the required documents. What
documents I didn't produce as per their decission?
As per vice cosul's statement what the UKBA decide as as response
to a Nationality matters.
As per the current decission,it is clear that that I satisfied BHC
by produced documents. Please refer reply from FCO below:

Dear Mr Faghurudeen,
Thank you for your e-mail enquiry of 05 March about your
application for a UK passport at the British Embassy in Kuala
Lumpar, Malaysia.
Your letter has been forwarded to Passport Policy and Procedures
Section for reply, as we have responsibility, within the Consular
Directorate of the Foreign & Commonwealth Office, for Passport
matters overseas.
I contacted our Vice Consul in Kuala Lumpur requesting that he
investigate the matters you have raised, and am now in a position
to issue a response. I understand that you were interviewed on 28
January, and that your application for a British Overseas Citizen
passport was refused in accordance with Section 26 of the British
Nationality Act 1981.
When determining a person's claim to British nationality we
consider the place of birth, the legislation in force at the time
as well as any ancestral links to the United Kingdom. On the basis
of the information provided, unfortunately, you have no claim to
British nationality.
Yours sincerely,
