Dear Isle of Wight Council,
At a public planning meeting on 23.03.2010 immediately prior to the
vote, Planning Officer Salmon, said, “The various permissions or
applications that have been dealt with in the recent past
particularly the major 25 hectare housing employment land scheme,
took all the environmental, landscape and highways issues into
account ...” Please provide all evidence and documentation to
support the assertion that the historic environment and its
significance were properly considered in these matters.

Dear Leal, Kelly,
I am aware that this request has been included as part of "Item 1"
request, presumably because the statement was made by the same
Council Officer and at the same time.
However, I am expecting an answer to two separate requests and I am
disappointed that the IW Council seems to have delayed a response
to "Item 1" by seeking a clarification that appears unnecessary and
contrary to the spirit of the guidance from the Information
Commissioner.
The Planning Officer made two separate statements to a public
meeting. Both must be accurate and both must be able to be
substantiated. The meeting in question was a few weeks ago so I
find some difficulty in understanding why there should be a delay
in providing the evidence I ask for under these circumstances.

Dear Leal, Kelly,
I gave evidence to the Planning Committee on 23rd March regarding
the relevance of the Osborne House Conservation Plan (OHCP) to
their considerations. I explained that it was some 200 pages of
objective evidence analysing the evolution of the wider Osborne
estate and its historical significance and that English Heritage
had provided a copy to the IW Council in 2002.
The Planning Officer did not dispute this. Instead he said, ""The
various permissions or applications that have been dealt with in
the recent past particularly the major 25 hectare housing
employment land scheme, took all the environmental, landscape and
highways issues into account ..." His response in context was
intended to reassure the Planning Committee the evidence I had
provided had been considered. The Head of Planning sitting
alongside him did not challenge his statement.
As planning applications P/00083/10 and P/00563/06 make no
reference to the OHCP and its evidence or recommendations, S21
exemption does not apply.
For the Planning Officer's statement to be true the evidence to
support his assertion must exist elsewhere. Please will you provide
it forthwith.

Further to your freedom of information requests I would like to apologise
for sending the one reply to you covering all requests. To correct this,
please find attached the documentation confirming the following
information.
Unfortunately I would like to reaffirm the position that the planning
files should be the source of the information that has been requested.
These files are public documents and provide the evidence that all of the
relevant and appropriate matters and considerations have been taken into
account and addressed by the planning officer in reaching a decision and
recommendation that is then, if appropriate, decided by delegated powers,
or presented to the Planning Committee for a decision.
Officers have confirmed that the Council's Conservation and Design Team
did provide comments to the application however these were with reference
to application number P/00519/07 (approval of reserved matters) Land at
Kingston East Cowes. A copy of this report is attached for your
reference.
On the issue of the Osborne House Conservation Plan our officers have
confirmed that the document is not a statutory document. It is a reference
document produced by English Heritage as an assessment of the area in and
around the Osborne Estate. It is not a formal policy document and to
English Heritage's own admission is out of date and should therefore not
be used in formal decision making. The Plan is however forming part of
background documents to the Council's consideration of whether the area
should be formally designated as a Conservation Area.
I would highlight however that the Council are undertaking a review of a
number of areas of the Island with regards to their Conservation status
and the Osborne Estate is not due for consideration for a number of years
due to the protection already afforded it by its listed and registered
park status.
I hope that this additional clarification provides you with the

Dear Isle of Wight Council,
Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Isle of Wight
Council's handling of my FOI request 'Re: Isle of Wight Council:
P/00083/10; TCP/29971 – Item 2'.
I do not believe the material requested has been provided and the
Section 21 Exemption is inappropriate as the documents cited as
being publicly available make no reference to the Osborne House
Conservation Plan to which my request specifically referred.
Reviewers will note that the IW Council has mixed and confused
replies between Items 1, 2 and 3.
