Thank you for your request for information under the Freedom of
Information Act for the Trust's responsibilities under the Data Protection
Act 1998. I can now respond as follows:

1. How many requests do you get under the DPA each year?

The full report for 2009/10 will be published in September. We do not
have a full report for previous years.

2. How do you verify the authenticity of DPA requests?

I have attached copies of the Trust Access to Health Records policy and
Data Protection policy

3. Do you conduct regular DPA audits/have an auditing policy?

I have attached a copy of our Data Quality policy. Other policies are
available on our website www.penninecare.nhs.uk

4. Do you maintain data on errors in information covered by the DPA?

We maintain a record of any requests for amendments to health records made
to the central subject access team.

I requested copies of my medical records in November 2008 and repeatedly thereafter. In March 2010 I wrote a letter of complaint to the CEO and eventually received the records in July 2010.

The records were grossly inaccurate and defamatory. There were records relating to 5 other patients included in my records, one of which was contained confidential and very personal data.

My records were missing for years, were eventually found in October 2008 and were missing again in February 2010.

I am currently in the complaints system with the Trust concerning these and other very serious matters, following which I will refer these matters to the Ombudsman, the CQC and the Information Commissioner.

I think the Government should address the problem of inaccurate records before implementing a national database. I am opting out of the summary care records system and would advise every citizen to do so unless they have examined their GP and hospital records and are satisfied that these are accurate.
