FREEDOM OF INFORMATION ENQUIRY

I refer to the request in your email of 11 September 2008 seeking details of applications for public entertainment and street trader's licences.

I would advise you that the following temporary licences were applied for by the Edinburgh Festival Fringe for the High Street and The Mound for the month of August 2008:-

Public Entertainment - Hunter Square, West Parliament Square and High Street (2 to 25 August 2008) - Fee Paid £85.00

Market Operator - High Street, West Parliament Square (2 to 25 August 2008) - Fee Paid £1180.00

Public Entertainment - The Mound Pedestrian Precinct (1 to 25 August 2008) - Fee Paid £100.00

Market Operator - The Mound Pedestrian Precinct (2 to 25 August 2008) - Fee Paid £1062.00

You will see from the above that there were no street trader's licences sought and that trading from the stalls was covered by market operator's licences.

All revenue generated took the form of fees payable to the licensing account. No revenue accrued to common good.

If you are not satisfied with this response you may write to the Director of Corporate Services, The City of Edinburgh Council, Waverley Court, 4 East Market Street, Edinburgh, EH8 8BG, within 40 working days of receipt of this letter, seeking a review of the response.

I refer to your email of 16 February 2009 in which you seek a response to
a request for information submitted to the Council on 26 October 2008 and
in respect of which you did not receive a reply.

Your request of 26 October asked when and where details of certain street
trading applications were made public or what consultation was carried out
with the local community prior to a decision being taken.

I have come to the decision that the best method of reviewing your request
and of dealing with your email of 16 February, is to provide the
information which should have been given to you following the October
email.

You should have been formally advised that since the applications were for
temporary licences with no history of prior problems affecting either
operators or stances there was no circulation of details of the
applications to Councillors or local libraries. This is the normal
processing procedure for such applications.

I would apologise for the failure to process properly your earlier
enquiry.

If you remain dissatisfied with the outcome of this review, you have six
months within which you may ask the Scottish Information Commissioner to
conduct a further review of my decision. You can contact him at:
