Dear Home Office,

Thank you for your reply. Is there any explaination for the
significant delay in responding? Indeed I suspect it may be even
courteous to apologise for such a long period in which my request
was not attended.

I will leave this request as 'open' until I have received a
response from both the Home office and the ICO, whom I refered this
matter.

RESPONSE FROM INFORMATION COMMISSIONAIRE

Dear Mr xxxxxxx

Freedom of Information Act 2000 (the FOIA)

Your information request to the Home Office

Thank you for your correspondence dated 2 March 2010 in which you complain about the Home Office’s failure to respond to your information request.

It is clear from the what do they know website that a response has now been provided by the Home Office. Although a clear breach of the Act did occur, the Commissioner does not consider that serving a formal decision notice would serve any strong public interest in this case. I have, however, written to the public authority reminding it of its responsibilities and recorded a breach of section 1 and section 10 of the FOIA on our system. I attach a copy of my letter for your information.

As outlined in my letter to the Home Office in the event of other, similar complaints, the Commissioner may consider taking enforcement action under s.52 of the Act. This case be used as evidence should any enforcement action be deemed necessary. The Commissioner’s Enforcement Strategy is available at the following link:

As you will see even though the Commissioner does not intend to issue a formal notice in this case, your concerns have been taken seriously. Thank you for bringing this matter to the attention of the Information Commissioner.
