Dear Harwood, Christopher,
My Freedom of Information request did not ask for any senstive
details about the people who have been arrested for kerb crawling.
Nothing that could indentify them would therefor be made public.
As the Freedom of Information Officer you are entrusted by the
public to handle data senstively. It is your public responsibilty
to provide the data that has been legally requested without
identifying people.
Given that all other UK police forces have provided the information
without identifying people, I am therefor requesting an internal
review of my application.
For your future guidance I have included sections 1 and 2 of the
Sexual Offences Act 1985 that deals with people arrested for kerb
crawling.
Soliciting of women by men
1 Kerb-crawling
(1)A man commits an offence if he solicits a woman (or different
women) for the purpose of prostitution—
(a)from a motor vehicle while it is in a street or public place; or
(b)in a street or public place while in the immediate vicinity of a
motor vehicle that he has just got out of or off,
persistently or, F1. . . in such manner or in such circumstances as
to be likely to cause annoyance to the woman (or any of the women)
solicited, or nuisance to other persons in the neighbourhood.
(2)A person guilty of an offence under this section shall be liable
on summary conviction to a fine not exceeding level 3 on the
standard scale F2. . ..
(3)In this section “motor vehicle” has the same meaning as in
[F3the Road Traffic Act 1988].

1988 (c. 54, SIF 107:1), s. 4, Sch. 4 para. 29
2 Persistent soliciting of women for the purpose of prostitution
(1)A man commits an offence if in a street or public place he
persistently solicits a woman (or different women) for the purpose
of prostitution.
(2)A person guilty of an offence under this section shall be liable
on summary conviction to a fine not exceeding level 3 on the
standard scale F1. . ..
Annotations:
Amendments (Textual)
F1Words in s. 2(2) repealed (5.11.1993) by 1993, c. 50, s. 1(1);
Sch. 1, Pt. XIV
Please be reminded that you have broken the law by not providing an
accurate response without genuine exemption in the public interest.
I look forward to receiving the exact number of people arrested for
the offence promptly.
Many thanks,
R Dewsbury
Yours sincerely,
R Dewsbury
