Dear Sir or Madam,
Under the Freedom of Information Act 2000 I request the following
information regarding the Scottish Information Commissioner’s
Office involvement in The National Archives proposal to phase out
The Office of Public Sector Information and or the OPSI brand, the
impact that the proposed actions will have on the UK’s policy and
implementation with respect to the re-use of public sector
information (Statutory Instrument 2005 No. 1515 – the UK
transposition of the EU Directive 2003/98/EC) and (the Protocol
between the Office of Public Sector Information and the Scottish
Information Commissioner, dated 11th August 2005)
The information requested to cover the period from the 1 July 2009
up to the time this request is answered.
Specifically, I need in relation to the phasing out of the OPSI
brand and The Office of Public Sector Information the following
information:
1. A list of written documents (including emails) received by the
Scottish Information Commissioner’s Office from the National
Archives – the list to include date, origin of the document,
position of the submitter (that is Job Title), to whom the document
was addressed (that is Job Title), the subject line of the
document.
2. A list of written documents (including emails) sent by the
Scottish Information Commissioner’s Office to the National Archives
– the list to include date, position of the author, the position of
the person(s) to whom the document was addressed in The National
Archives, the subject line of the document.
3. A list of meetings held between one or more of the Directors of
The National Archives and the Scottish Information Commissioner’s
Office. List to include: date, place and position of the people
involved in the meeting.
4. A list of planned (schedule meetings) between one or more of the
Directors of The National Archives and the Scottish Information
Commissioner’s Office that will have on the agenda one or more of
the following topics: the OPSI brand; the Office of Public Sector
Information; the complaint handling procedures as outlined in the
Statutory Information 2005 SI 1515; the Protocol between the Office
of Public Sector Information and the Scottish Information
Commissioner.
I would prefer to receive the information electronically.
If the decision is made to withhold some of this information using
exemptions in the Act, I would be grateful if you would please
inform me and cite the exemptions used.
If you need any clarification then please contact me via email.
Under your section 16 duty to provide advice and assistance I would
expect you to contact me if you find this request unmanageable in
any way.

I am writing in response to your request of 11 August 2009 in which you
ask for information about involvement of the Office of the Scottish
Information Commissioner in a proposal by The National Archives to phase
out the OPSI brand and the Office of Public Sector Information (OPSI). You
specified that you would like to receive the following types of
information, related to this issue, recorded for the period 1 July 2009 to
present:
1. A list of written documents (including emails) received by our office
from the National Archives
2. A list of written documents (including emails) sent by our office to
the National Archives
3. A list of scheduled meetings between the National Archives and our
office
The Office of the Scottish Information Commissioner does not hold any of
the information which you have requested - we have had no correspondence
on this issue, nor held any meetings with The National Archives or OPSI in
the period in question.
Although you specified that you were making the request under the Freedom
of Information Act 2000, I have responded to it in accordance with the
Freedom of Information (Scotland) Act 2002 (FOISA) which applies to the
Scottish Information Commissioner. Under FOISA you have the right to ask
