Dear Hillingdon Borough Council,

The Conservative Party for Hillingdon Council in their recent
manifesto said that there would be refurbishment to the Highgrove
Swimming Pool and the public libraries. As a local
multidisciplinary architectural design and quantity surveying
practice we will be very interested in tendering for those
projects.
As I have had some difficulty in obtaining information on these
projects will the Procurement Department please provide the
following information on the tenders?

Highgrove Pool
1. Please provide the anticipated total cost of the Highgrove pool
project?
2. When will the tenders be advertised for the role of architect
and quantity surveyor?
3. In what publications will the tenders for the role of architect
and quantity surveyor be advertised for this project?
4. If already appointed when were these tenders advertised and in
what publications for each role?
5. If so what was the tender return date for each role?
6. Who were the companies that tendered for each role?
7. Who were the successful tenderers for each role?

Library refurbishment programme
8. What is the total value of the library fit-out and refurbishment
programme including completed, underway and planned for the future.
9. What is the value of fit-out/refurbishment works under this
programme already completed or underway?
10. What is the value of work still to be tendered under the
fit-out/refurbishment programme?
11. Who are the architects and quantity surveyor on the projects
previously carried out?
12. When were the tenders for the role of architect and quantity

LBH have accessed Buying Solutions framework RM457, for the delivery of
Project Management & Full Design Team Services. All Buying Solutions
Framework Agreements comply with European procurement legislation. The
Framework Agreement was awarded in compliance with the provisions of
Directive 2004/18/EC (the "Consolidated Directive"), as enacted in
England and Wales by Statutory Instrument 2006 No. 5.

In line with council constitution, there is no requirement to tender
these contracts.

13) What is the value of fees already commissioned for each of the
architects and quantity surveyors on these projects?

The Council can confirm that it holds this information but we are of
the opinion that this information is caught by one or more of the
Freedom of Information exemptions.

In this instance the Council is of the view that the information is
exempt pursuant to S43 (2) of the Freedom of Information Act 2000 which
states that information is exempt if its disclosure would prejudice the
commercial interests of any party. The council has considered the
public interest in this matter and is satisfied on balance that, in this
instance, the public interest is in favour of the information being
withheld.

14) When will the tenders be advertised for the future works for the
role of architect and quantity surveyor?

LBH currently have agreements in place to deliver the requirements and
as such, subject to approval of schemes, may not be advertised.

Dear Hillingdon Borough Council,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Hillingdon Borough
Council's handling of my FOI request 'Procurement'.

I find it unbelievable that with a project worth over £3million
that it is not necessary in terms of your procurement rules to
tender for the services. I consider that it must need further
investigation as to why such a large portion of work is not subject
to tendering procedures which should be open to all as a matter of
fairness.

From enquiries I have made I have also been informed also that the
QS you are dealing with, Gleeds, is the Newcastle office. Quite
ridiculous, what is wrong with giving smaller and more local
companies the opportunity to tender for these smaller and medium
sized projects. Furthermore I have been informed that Gleeds will
get the work for the Highgrove renovation. How can this be if there
is supposed to be a fair tendering process?

If you do not take steps to ensure a fair and open tendering
process I am sure the Office of Fair Trading will take a dim view
of this.
