Dear Sir or Madam,

I am trying to find the University's policy on publications by
post-graduate students; specifically, in the absence of a
project-specific confidentiality agreement, whether the University
claims any right of veto over academic publications by students, or
any right to dictate the terms
of publication.

In the CODE OF GOOD PRACTICE IN RESEARCH (Nov 2002) [1], I have
found the following statement: "Custom and practice in the
University, in common with most other Universities, is for the
University to waive rights to copyright of specific articles to
enable authors to assign copyright to publish specific articles in
journals or books. Again unless otherwise agreed, the University
does not own the output from its students’ research. If it is
necessary for the University to own this IP (e.g. as a result of a
sponsor’s requirements) then this must be the subject of specific
written agreement with the student."

This would appear to suggest that the university would not normally
have any grounds to prevent a student from publishing their work.
However, I am not certain whether this forms the whole of the
University's policy, or if there are other documents that must also
be taken into consideration.

If there are any other policy documents relating to this issue, I
should be grateful if you would bring them to my attention.

Thank you for your message regarding the University's policy on publications by Post-graduate students. The code of Good Practice in Research is the only formal policy document that covers this issue within the University of Edinburgh. I have also discussed your enquiry with the Head of Legal at Edinburgh Research and Innovation Limited ("ERI"), the subsidiary company of the University that deals with pre-award research administration and her comments are as follows:

"I know of no policy or practice in our University which seeks a right of veto over academic publications by students, or any right to dictate the terms of publication. In all ERI's dealings with third parties in contractual documentation we seek to preserve the University's and the student's right to publish their work freely. In so doing we see ourselves as implementing fundamental principles of the University's mission. Of course, though, we often have to accept restrictions on publications when we have commercially sponsored research. In these cases our employees, researchers and students are dealt with similarly."
