Position regarding East Hill lift

Mr P Wood made this Freedom of Information request to Hastings Borough Council

The request was partially successful.

From: Mr P Wood

26 June 2009

Dear Sir or Madam,

What is the cost of repairing the East Hill lift so that it can
return to use?

How much money have you spent on the East Hill lift
during the past fifteen years and on what dates?

To whom was the money paid and what was it paid for, under the
terms of any contracts? What tendering process was used?

What provisions were included in the contracts to enable redress in
the event of unsatisfactory performance of the contracts?

What is the name of the lawyer who agreed the contracts for the
Council?

Are you satisfied with the performance of the contracts?

Are you considering legal action in respect of any of the contracts
and what is the name of the lawyer who is making or has made the
decision to take or not take legal action?

When will the East Hill lift be usable again?

Yours faithfully,

Mr P Wood

What is the cost of repairing the East Hill lift so that it can return to
use?
The value of the current tender, East Hill Lift only, is £424,659. This
is part of a larger contract covering both lifts.

How much money have you spent on the East Hill lift during the past
fifteen years and on what dates?
The following total amounts were spent during the financial years 1997/08
to 2009/10 (to date):
1997 5,305.38
1998 31,477.99
1999 10,021.52
2000 35,089.68
2001 14,945.36
2002 19,592.49
2003 26,461.24
2004 18,074.54
2005 48,138.00
2006 4,438.00
2007 6,352.00
2008 3,205.00
2009 1,081.00
A copy of information held from which these totals are derived is
attached. We only hold records from 1997.

To whom was the money paid and what was it paid for, under the terms of
any contracts? What tendering process was used?

Please see the attached information. No work was of a large enough value
to require public tender.

What provisions were included in the contracts to enable redress in the
event of unsatisfactory performance of the contracts?

Orders for the above would have referred to Hastings Borough Council's
standard contract terms.

What is the name of the lawyer who agreed the contracts for the Council?
This information is not held. Lawyers do not agree contracts - their
clients do.

Are you satisfied with the performance of the contracts?
This information is not held.

Are you considering legal action in respect of any of the contracts and
what is the name of the lawyer who is making or has made the decision to
take or not take legal action?

This information is not held.
Lawyers do not make the decision to take legal action in respect of a
contract - they may advise on legal points but the client will make the
decision based on that advice.

When will the East Hill lift be usable again?
The East Hill Lift is likely to reopen in Spring 2010, subject to final
testing and sign-off.
