Policy on removal during ongoing family proceedings

Dear Sir or Madam,

I write to request disclosure under the Freedom of Information Act
the UK Border Agency policy referred to at paragraphs 24 and 27 of
the judgment of the Court of Appeal in MS (Ivory Coast) v Secretary
of State for the Home Department [2007] EWCA Civ 133. I have looked
carefully through the various policy documents on the UKBA website,
including the Immigration Directorate Instructions, but can find no
reference to this policy.

For clarity, the policy appears to be that removal action will not
be pursued while a person is pursuing family proceedings relating
to children.

I request disclosure of the exact terms of the policy and the
circular or other document that sets out the precise details of the
policy.

Dear Jalil Marion,

Thank you for your holding letter dated 24 February 2010, but I
made my request on 22 November 2009. It is now considerably over
three months later. I would be grateful if my request could be
actioned as soon as possible.

If I do not hear soon I will be making a complaint to the
Commissioner.
