Dear Sir or Madam,

Freedom of Information Request - Police Injury Pension Reviews 1987
- 2009.

In an FOI request made by Ms N McCall on 29th January 2009,
Cheshire Constabulary were asked to state its policy towards injury
pension reviews prior to 2004. The Constabulary was asked to state
whether it belonged to either:

Category A - forces that automatically reduced degree of
disablement benefits to the lowest banding when compulsory
retirement age had been reached; or

Category B - forces that continued to pay benefits at the same rate
until the death of the Officer concerned.

On 2nd March 2009, Sarah Davies responded to this request by saying
that “Cheshire Constabulary both pre and post circular 46/2004 were
category A”.

I am writing under the Freedom of Information Act to ask Cheshire
Constabulary to:

1. Advise how many reviews of injury pensions awarded to former
officers were carried out when the recipients reached the age of 65
years between 1987 and 2003.

2. Advise how many reviews of injury pensions awarded to former
officers were carried out when the recipients reached the age of 65
years between 2004 and 2009.

Please note that I am not asking how many awards were automatically
reduced, but how many reviews were actually carried out.

Dear Mr Wray,

I refer to your recent request for information under the Freedom of
Information Act 2000 as set out below:

1. Advise how many reviews of injury pensions awarded to former officers
were carried out when the recipients reached the age of 65
years between 1987 and 2003.

2. Advise how many reviews of injury pensions awarded to former officers
were carried out when the recipients reached the age of 65
years between 2004 and 2009.

In accordance with section 1 (1) (b) of the Act our response is provided
below;

Firstly, having looked back at your previous request it appears that the
information given was in fact incorrect, Cheshire Constabulary have always
been Group B, which continued to pay benefits at the same rate until the
death of the Officer concerned, not Group A as originally advised, please
accept our apologies for this error.

Secondly, to date we have not reviewed injury awards.

If I can be of any further assistance in this matter, please do not
hesitate to contact me.

If you are not satisfied with the decision applied in this case I enclose
for your attention a copy of the Constabulary's appeal procedures.
