Policing cars parking on footways

Dear Sir or Madam,

It is clear that vehicles see a footpath adjacent to a road as
"fair game" when parking, particularly on housing estates. This can
cause serious problems for mothers with prams, disabled people,
elderley people (particularly those in wheelchairs). Often it is
necessary for pedestrians to walk out into the road itself -
conflict with vehicles then occurs. What is your policy on this
matter and what measures can be taken to eliminate this problem.

I refer to your letter dated 26^th September concerning parking on the
footway, which has been passed to me for processing under the Freedom of
Information Act. The information held by Wiltshire Council has been
collated and the following response is provided:

1. Wiltshire Council, as highway authority has powers to enforce formal
parking controls and vehicles found to be parked in contravention of
parking regulations will be issued with a Penalty Charge Notice
(PCN). Accordingly, where there are yellow line restrictions action
is taken when a vehicle is observed parked on a footway as the waiting
restrictions/traffic regulations apply to the whole width of the
highway including the footway and/or verge. In the majority of
residential areas there are no such restrictions applied to parking
and we have no powers to take enforcement action. In the absence of
formal parking controls obstruction of the footway is a matter for the
police. As you have not given a specific location we are unable to
provide any further comment.

The council has not withheld any information in relation to this request
under the exemptions of the Freedom of Information Act 2000. I hope the
information received is what you were expecting. However if you are
