Dear Cath,

By "Response Duty" we mean officers assigned to respond to calls
from the public, presumably those on shift duties, who would attend
calls from the public, such as beat officers, police vehicle
drivers, dog officers, traffic etc. (Inspector, Sergeant, PC)

By "Administerial" we mean those officers specifically assigned to
roles that are office based, such as audit, police administrative
roles that by virue of the job, mean that they work in an office
for their tour as opposed to responding to public calls."

Dear Cath,

We have now received responses from 35 of the 43 forces.

I understand from other forces, the Home Office classsification
divides roles by Operational, Operational Support, Organisational
and Organisational Support. These categories are fine for our
purposes.

To assist, most forces have provided :-

1.A full count of officers by rank
2.A count of all officers that respond to public calls.
3.A list of the non response administerial departments
4.Non response administerial departments to include count of all
officers assigned to office based duty as opposed to responding to
public calls requiring attendance.

As the reply date has passed, I wonder if you could advise when the
information requested will be available.

With reference to your request for an update on the status of your
request, we wrote to you on 12 January requesting clarification of some
of the terms used in your request. Your response was subsequently
received on 24 January. Whilst awaiting clarification from an applicant,
the clock is effectively "stopped", and the 20 day deadline then amended
in line with the length of time taken to receive the clarification. In

I write in connection with your request for information dated 7^th January
2010 and received in the Freedom of Information Unit on the 8th January
2010 regarding Police Resources.

This request is being handled under the Freedom of Information Act 2000.

Your request for information has now been considered and firstly I am
obliged under s1 (1) (a) of the Freedom of Information Act (FOIA) 2000 to
tell you whether the information is held by the Force. Please see the
attached response document which indicates what information is held by the
Force and the exemptions applied concerning the non release of the
information in whole or in part.

Where exemptions have been applied, Section 17 of the Freedom of
Information Act 2000 requires Dyfed Powys Police, when refusing to provide
such information (because the information is exempt) to provide you the
applicant with a notice which: (a) states that fact, (b) specifies the
exemption in question and (c) states (if that would not otherwise be
apparent) why the exemption applies.

The following exemption has been applied to the information you have
requested.

Section 12 - The cost of compliance exceeds the Appropriate Limit

A Section 12 has been applied to all of your request because in order for
us to establish whether there is any information held in respect of
Question 2 is above the amount to which we are legally required to respond
i.e. the cost of locating and retrieving the information exceeds the
"appropriate level" as stated in the Freedom of Information (Fees and
Appropriate Limit) Regulations 2004. It is estimated that it would exceed
18 hours (i.e. minimum of 3579.9 hours) to comply with this part of your

Question 2

It has been established that the information requested in respect of
Question 2 is not held in an easily retrievable format, in order to
ascertain whether the information you have requested is held would involve
all 1193.3 police officers in the force checking their pocket note books
for the period in question.

A pocket note book is a note book that police officers are allocated and
maintain with handwritten notes I am informed that a pocket note book
contains 150 pages. A breakdown of the work involved is provided below:-

It has been estimated that a police officer will use between two and four
pocket note books annually and that it would take an officer approximately
an hour to check each notebook for any information. I have now broken the
calculation to explain further:

Average of three pocket notebooks a year @ 1 hour per book, equates to an
average of 0.25 books per month.

1^st of January 2009 to 31^st December 2009 = 12 months

12 months x 0.25 books x 1193.3 = 3579.9 Hours

In order for Question 2 to be answered, the period of time over which the
information has been requested would have to be considerably shortened to
be within the appropriate limit.

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for this request under Section 17(5) A public
authority which, in relation to any request for information, is relying on
a claim that section 12 or section 14 applies must, within the time for
complying with section 1(1), give the applicant a notice stating that
fact.

However, you may wish to refine and resubmit your request so that it
reduces the time shown above to fall within the 18 hours. Please contact
me if you would like some advice on refining your request.

Please note: If any part of a request exceeds the time cost threshold of
18 hours (the amount to which we are legally required to respond) i.e. the
cost of locating and retrieving the information exceeds the "appropriate
level" as stated in the Freedom of Information (Fees and Appropriate
Limit) Regulations 2004, then the whole of the request may be refused.

Although excess cost removes the force's obligations under the Freedom of
Information Act, as a gesture of goodwill, I have supplied information
below relative to your request, which was retrieved or available before it
was realised that the fees limit would be exceeded. I trust that this is
helpful, but it does not affect our legal right to rely on the fees
regulations for the remainder of your request.

Thank you for the detailed reply.

However, it may be that the format of the 38 responses provided by
other forces may assist.

It has been explained to me that the Home Office classify the
officer functions as Operational, Operational Support and
Organisational Support. I have also been provided with a copy of
the Home Office Annex c definitions of the 62 main functions
officers may occupy. (I can copy this for you if you need it).

This has proven to be a simpler way to arrive at the information.

Forces have provided the list of numbers operational officers, by
function and rank and the same lists for Operational Support and
Organisational Support.

I understand it is easier and faster to retrieve information in
this format. As the responses provided are visible on the "What Do
They Know?" site, I have reprinted below the Avon & Somerset as an
example of the typical response in the hope that this might assist
you.

Dear Liz,

I may be able to simplify question 2 dramatically for you.

I am advised by the other forces that the Home Office Function
definitions are used by all forces as a generic record of officer
numbers.

(Appendix A of the 62 Home Office function definitions).

The category fitting the description we are looking for is
definition(30) 1. Foot/Car/Beat Patrol –
Operational.

Forces have found it simplest to return this number, rather than
the time consuming task involved in separating each function, which
I appreciate may be the problem you have encountered.

I hope this assists. Of the other data (1) is available elsehwere,
and (3) & (4) were only support items to the core enquiry.

Dear Mr Bennett

Thank you for your email of the 8^th March 2010 the contents of which are
noted.  However, as outlined in my original response and the follow on
email to your queries the situation remains the same.

Unfortunately, due to the fact that the information you have requested is
not recorded in Dyfed Powys Police in a simplified format as suggested, in
order to retrieve and collate the information you have requested would
still necessitate contacting the 1193.3 Police Officers in the force for
that period to collate or retrieve any information held which would take
3579.9 hours.  Therefore, as explained in the original response the cost
of compliance exceeds the Fees & Appropriate limit of 18 hours or £450
cost.

As a result I am unable to progress this matter any further.
