Dear Avon and Somerset Constabulary,

I am making a request for all the information to which I am
entitled under the Freedom Of Information Act. In order to assist
you with this request, I am outlining my query as specifically as
possible. If however this request is too wide or too unclear, I
would be grateful if you could contact me by e-mail, as I
understand that under the act, you are required to advise and
assist requesters.

I would like to know:

1) How many former officers of Avon and Somerset Constabulary are
currently in receipt of an injury award pension, as provided for in
the Police Pensions Regulations 1987 and the Police (Injury
Benefit) Regulations 2006?

2) Do you operate a policy of reducing an injury award pension to
the lowest permissible band when the former officer reaches the age
of 65?

3) In the years 2004 to 2008 inclusive, how many former officers’
injury award pensions were reduced to the lowest banding upon the
former officer reaching the age of 65? (A total figure only is
requested, but I have no objection if you break the figures down by
year)

4) In the years 1987 to 2003 inclusive, how many former officers'
injury award pensions were reduced to the lowest banding upon the
former officer reaching the age of 65? (A total figure only is
requested, but I have no objection if you break the figures down by
year)

I understand that under the FOI Act, I should be entitled to a
response within 20 working days. I look forward to hearing from you
in the near future.

published for public scrutiny on the web site through which this

Dear Mr Jarman

Thank you for your request for information dated 8^th April relating to
Police Officers’ injury award pensions. This request will be dealt with
under the terms of the Freedom of Information Act 2000.

Your request will now be considered and you will receive a response within
the statutory timescale of 20 working days as defined by the Act, subject
to the information not being exempt or containing a reference to a third
party. In some circumstances Avon and Somerset Constabulary may be unable
to achieve this deadline. If this is likely you will be informed and given
a revised time-scale at the earliest opportunity.

There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make a payment then your request will
remain unanswered.

Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.

Dear Freedom of Information Officer,

I regret to have to inform you that you are, as of the 13th June,
33 days late in providing a response to my FOIA request for
information.

You advised that you needed an extension until the 10th of June and
that self-imposed deadline has now passed.

You will be aware that you are in breach of the requirements of the
Act and I must therefore advise that unless a response is
forthcoming very promptly I will have no alternative but to report
your lapse to the Information Commissioner.

Dear Mr Jarman

I write in connection with your request for information dated 8th April
2009 concerning Police Officers' injury award pensions.

Your request for information has now been considered and some of the
information asked for in the form of a partial response is below.

2) I can confirm that the Constabulary has adopted the Home Office
guidance in respect of reducing an injury award pension to the lowest
permissible band on the attainment of the National CRA. However, this is
not an automatic process based on the former officers' 65th birthday - an
examination by the Force Medical Adviser is required before the reduction
can be made so that the circumstances of the individual can be assessed.

3) With the answer to question 2 in mind, in the years 2004 to 2008
inclusive, 3 former officers’ injury award pensions were reduced to the
lowest banding upon them reaching the age of 65.

4) No information is held from 1987 to 2003 in relation to the number of
former officers' injury award pensions being reduced to the lowest banding
upon them reaching the age of 65.

In respect of question 1, work is still being undertaken in an attempt to
provide you with the figures requested and I can assure you that as soon
as they become available, they will be e-mailed to you. I am hopeful that
this should be by the end of this week.

I would like to take this opportunity to thank you for your interest in
Avon and Somerset Constabulary and apologise for the delay in providing a
full response.
