Dear Hertfordshire County Council,
On 12th November 2009 I complained about the obstruction of Grove
Road, , by spoil and concrete bollards.

18 weeks later, on 22nd March 2010 I was told "There is at present
an investigation taking place that is related to your concerns
regarding Grove Road. The report is due to be completed by mid
April."

23 weeks after my initial complaint, the spoil and bollards are
still there.

Please now send me a copy of the results of your investigation (as
previously requested).

Hertfordshire County Council have written to WhatDoTheyKnow drawing our attention to the fact they ineffectually redacted the document they initially sent in response to this FOI request.

The content which the council attempted to redact can be viewed either by clicking on the "View as HTML" option, or in many PDF readers by simply by selecting and highlighting the blacked out text. Copying and pasting the text the council tried to redact from the PDF document is also possible.

The council have asked us to replace the document with a new version, which they have supplied, and will appear on this thread below. While we remove sensitive personal information when our attention is drawn to it, the information accidentally released by the council does not come in to that category, therefore we are continuing to make it available. Details of our policies relating to removing personal information from the site are available on our help page at:

I am surprised by the extent of the council's attempted redaction in this case. For example the request was about an investigation into Grove Road and in the response even the word "Grove" is redacted. The council have taken an extreme position with respect to the definition of personal information. This is understandable this to a degree as the definition in the DPA (and incorporated into the FOIA) is very broad. I think there is significant public interest in the information which the council attempted to redact being made available to the public; as it may aid many people with an interest in the legal position relating to private roads.

We do not want users of our site to obtain less information than they would have done if the request had been made outside of the site. Had the request been made directly the requestor would have obtained the ineffectually redacted document.

Francis Irving left an annotation (19 August 2010)

A response has been deleted from this request.

It was sent on 4th May 2010, and had an attached PDF containing a copy of the requested report. The copy had many attempted redactions, which were carried out technically in an incorrect way, such that the entire report was easily visible.

A report redacted as originally intended appears in the response above dated 3rd June 2010.

As Richard describes above in an annotation dated 3rd June 2010, we believe the redactions were excessive. For a while we continued to publish the unredacted report, and for a while we made our own more minimal redactions to it.

Following a complaint under the Data Protection Act, we are temporarily no longer publishing this less redacted version of the report. Pending further investigation, we may publish it again, or a differently redacted version.
