I am assuming that you are referring to a Section 106 Agreement dated 22 October 2004 and to this end I have attached copies of two documents on file with that date. If you can confirm which, if either, is the document you are referring to I will check the records for any amendments that may have been made since that date.
With reference to your other request, Roger Willison-Gray [[email address]], there are a number of Section 106 Agreements to which Mid Suffolk District Council is a party but as this is a highway matter your request would be more appropriately directed to Suffolk County Council who is the responsible authority.

Dear Valerie Coe,
Thank you for you response, I should like copies of minutes,
amendments,revisions, letters and any other relevant material
pertaining to the two documents which you have kindly provided so
that I can ascertain the current agreement between Crest and MSDC
and their respective legal obligations.
With regard to the second request I understand that the
construction of the bridge is a highways matter but my interest is
in the funding arrangements for the bridge especially in any
section 106 agreements or through any funding channel which MSDC
provides. It is my understanding that a special fund was
established for this referred to as the "Stowmarket Bridge Fund".
Please confirm what funding was provided through either section 106
Agreements or directly by the council.

Dear Valerie Coe,
Thank you for your reply
I simply need to establish that the agreement has not been amended
or updated in any way and that the provisions of the agreements are
therefore legally enforceable.
It was my understanding from a letter I received that these
agreements were no longer binding as they had been superceded by
later versions and amendments.
This now appears not to be the case.
I would just ask that you confirm to the best of of your ability
that these documents have not been modified, amended, updated or
replaced since they were executed and that no subsidiary agreements
are in place in regard of the obligations in these agreements

I have made further enquiries of both the legal and planning departments and am advised that we are not aware of any variations to the agreements relating to planning permission OL/33/01. I see that you received a letter indicating that there had been some variation, if the letter was from a department of the Council, or if it indicated a specific variation to achieve a particular objective, I could make enquiries of the relevant officer.
