Dear Mr Faeroy and Miss Whitehurst
Thank you for your e-mail of 15^th October re the above.
In your e-mail you have requested all information held on Alison
Whitehurst held by the above charity under the Freedom of Information Act
2000 and under the Data Protection Act 1998 subject access rights.
You have requested that we obtain all relevant information from the
charity on Alison Whitehurst, as you seem to be having a problem getting
access to it.
You are asking for information held by the Pituitary Foundation, not by
the Charity Commission. The Commission does not have access to the
Pituitary Foundation***s records and is therefore unable to provide the
information you request.
It is the Information Commissioner***s Office (ICO) that enforces and
oversees the Data Protection Act and the Freedom of Information Act. This
being the case, I can only provide guidance on where to find further
information to help you with your request for information from the
charity.
The ICO web-site provides advice and guidance on their role in more
detail. It also outlines the provisions of the Acts mentioned above
including: what type of information you can request access to, how to
access that information, and how they can help if you are having trouble
accessing it.
The Freedom of Information Act 2000 only applies to accessing information
held by public authorities. As the charity is not a public authority; it
is not obliged to disclose information under the Freedom of Information
Act 2000. However, the charity, by law, has to comply with the Data
