Dear Deborah Croney (via whatdotheyknow)

Thank you for your request for information regarding performance of
category A targets for Blackmore Vale which we received on 21^st May 2009.

We will deal with this in accordance with your right of access to
information we hold under the Freedom of Information Act as requested and
I attach a leaflet containing further information about both your rights
and our obligations under this legislation. You will see from this that we
are not obliged to generate information we do not already hold in order to
provide what we are asked for, such as by collating data or formulating
direct answers to questions, but you are entitled to receive copies of
records (or extracts from them) that contain the information you have
requested.

Please be advised that we will, however, be unable to supply the
information you have requested through the web site service you have used
unless they confirm that the response will not be published on their site
without our permission as required under the Re-use of Public Sector
Information Regulations. I refer you and the service you are using to
[1]http://www.opsi.gov.uk/advice/psi-regula...
in this regard, but can I draw your attention in particular to the fact
that there is no obligation upon us to grant permission for the
information to be published in this way. Please can you therefore either:

1. Arrange for them to confirm that they will not publish the response
as they advise is their practice on their web site;

2. Submit a written request to re-use the information in this way which
we will consider in accordance with the regulations; or

3. Provide us with an alternative means of providing you with this
information, eg a different e-mail not linked with this site or a postal
address

Before we can extract the data you have requested, we will need you to
clarify the area covered by `Blackmore Vale' as we hold no definition of
the area this covers. Please can you therefore supply the postcode areas
we should include, or define the area in such a way that we can be sure we
are providing you with the information you require. Once we have this, I
will ask our Information Management Team to research the information you
have requested and we will respond providing what we hold within 11
working days in accordance with the timescales set by the Act.

We will inform you if:

a) We are unable to provide you with any of the information you have
requested, and explain the reason for this; and

b) Any fee is payable for the information we are able to provide.

In the meantime, if you have any queries or require clarification on any
aspect of your request or how we will respond, please do not hesitate to
contact me.

Yours sincerely

Carla Bryan| Information Governance Manager

Is there any advantage to just bringing this request up through your MP? Because then it is highly unlikely that SW Amb will dodge your request for information. More and more the FOI requests seem so sidelined by exceptions/ exemptions that they have become almost pointless.
Ultimately using the MP and acquiring that information WHICH SHOULD BE A MATTER OF PUBLIC INTEREST to the tax payers and service users of Blackmore Vale can become publicizable without yet another exemption of FOI requests getting in the way.
My sympathy is with you.
