Dear Sir or Madam,

Under the Freedom of Information Act 2000 I would like to request
the following information with regard to the bus lane in Clapham
Park Road just before the junction with Abbeville Road:

1. How many PCNs have been issued for each of the last five years
at this location for contravention code 34J?
2. How many of those issued were contested for each of the last
five years?
3. How many PCNs have been paid and what revenue has been received
for each of the last five years?
4. Of those PCNs issued, how many were subsequently cancelled by
Lambeth prior to listing at tribunal for each of the last five
years?
5. How many PCNs were cancelled at formal stage where the lines and
signage have been an issue for each of the last five years?
6. Of those PCNs issued, how many were listed for appeal at
tribunal for each of the last five years?
7. Of those PCNs listed for tribunal hearing how many were not
contested by Lambeth for each of the last five years?
8. How many PCNs have been cancelled due to a “NO CONTEST” at
tribunal stage for each of the last five years where the lines and
signs have been an issue?

I write further to your Freedom of Information Request to the London
Borough of Lambeth, received on 14 October 2009.

You have requested the following information pertaining to a bus lane
located in Clapham Park Road before the junction with Abbeville Road.
Please find the answers to your questions below:

1. How many PCNs have been issued for each of the last five years at this
location for contravention code 34J?

Please find the attached document for your perusal.

3. How many PCNs have been paid and what revenue has been received for
each of the last five years?

This is unclear; unfortunately you will need to stipulate whether you wish
figures to include part payments before a response can be provided.

4. Of those PCNs issued, how many were subsequently cancelled by Lambeth
prior to listing at tribunal for each of the last five years?

Although we were unable to provide the specific breakdown you required,
please find attached document listing all PCNs which have been cancelled.

5. How many PCNs were cancelled at formal stage where the lines and
signage have been an issue for each of the last five years?

Please see answer to question 4.

6. Of those PCNs issued, how many were listed for appeal at tribunal for
each of the last five years?

As the Parking and Traffic Appeals Service (PATAS) is independent of
London Borough of Lambeth we do not hold the information requested on
appeals. When an appeal is submitted to PATAS an independent Adjudicator
investigates the case, and as is this is the final stage of the statutory
appeals process, the final decision is binding in law.

7. Of those PCNs listed for tribunal hearing how many were not contested
by Lambeth for each of the last five years?

8. How many PCNs have been cancelled due to a "NO CONTEST" at tribunal
stage for each of the last five years where the lines and signs have
been an issue?

Please see answer to question 4.

The lack of answer to Mr. Campbell's fourth question (and, by extension, questions five, seven and eight) should be noted; it appears evasive, since it seems to imply that while Lambeth Council can provide references to PCNs that they have cancelled, they cannot explain WHY each one was so rescinded.
