PCN notices - compliance with PATAS judgements

Dear Haringey Borough Council,
I refer to Charge Certificate number HY75276752, which refers to a
previous PCN HY75276752 which I have never received.
In this document I am accused of committing an offence when
entering a yellow box junction in "Green Lanes".
I refer to the "Joint Annual Report of the Parking Adjudicators to
The Association of London Government Transport and Environment
Committee 2006-2007" and in particular the case "Inadequate
description of contravention in PCN: location insufficiently
identified 'Adamou v Haringey (PATAS Case No. 2060381000)" page 33,
which refers to High Street.
Also 'Reeve v Haringey’ (PATAS Case Reference 2060376463) which
refers to Green Lanes.
These judgements and others clearly require the PCN to give an
adequately specific location for an offence, in particular that the
PCN should state the location e.g in terms such as ,"High Road N22
at its junction with Bounds Green Road" and not just state one
road, e.g. "High Street N22" and "Green Lanes N4" were ruled
inadequate.
It is clear that the CC sent to me did not met this requirement and
is probably invalid. It is also probable that many PCNs with
similarly inadequate descriptions have been sent to others.
I wish to know :
1) How many PCNs for Yellow Box offences have been sent out with
this inadequate description, for Green Lanes, and High Street?
2) Is this practice continuing now?
3) How many PCNs have been successfully appealed to PATAS on the
similar basis's of 'Inadequate description of contravention in PCN:
location insufficiently identified' over the last 2 years.
In a previous FOI I requested to know how many non-compliant PCNs
had been issued to date since the Adamou case. Apparently Haringey
Council do not store this information in an easily retrievable,
searchable form; the records have to be searched manually and the
cost would be excessive to do this. Given that the CC was generated
by computer on a Bank Holiday I find this inexplicable!
I therefore suggest that questions 1 and 2 be answered as an
estimate e.g. by sampling the records on three dates i.e. 26
December 2009, 10 March 2010 and 13 August 2010. The entire day
need not be examined, simply enough across the day to obtain a
representative sample. If time permits, additional days could be
added.
The sampler can simply examine the PCNs in number order, and note
how many correctly identify the location of any Yellow Box offences
by stating the junction of two roads, and how many state only a
single road.
The numbers can be reported as totals and a percentages.
If possible, the number of PCN's for High Street and Green Lanes
which are not in compliance with the PATAS judgements could be
specifically recorded and reported.
Question 3, the number of sucessful appeals to PATAS and their
grounds, should hopefully be a much smaller number and be more
easily available.

Chris, I hope your posts are not removed. Yes, the link you gave was to a PCN issued by the London Borough of Enfield. (Green Lanes continues across the borough boundary to Palmers Green.)
But this doesn't affect the general point. Enfield too issued a PCN without giving the specific location - instead using "Green Lanes N13".
I wonder how many other local councils continue to ignore the unequivocal ruling of the Parking Adjudicator in the Adamou case that to be valid, a PCN must state:
". . . not just the nature of the alleged contravention, but where it was said to have occurred."
The two photos Enfield supplied are no help. As far as I can see, they simply show cars and an unidentified yellow junction box.

Hi Chris,
I got the email below from Niall Bolger, Director of Haringey Urban Environment. It seems to cover the key points I've raised; and gives clear reassurance that Haringey is doing its best to send PCNs which comply with the law and Adjudicators' decisions.
I have one quibble - which is Mr Bolger's comment that: ". . . we will not cancel PCNs on technicalities where it can be avoided".
Plainly, local councils are not above the law. And in my view, our implicit 'bargain' with residents includes getting the lines and signs *right*. It's not a 'technicality', but about professional standards.

Thank you for your further enquiry relating to the enforcement of yellow box junctions and our compliance with statutory requirements. I am sorry that our previous replies failed to reassure you that that our parking recovery processes meet statutory requirements and ensure fairness of process for motorists.
I can confirm that the parking service will ensure that all PCNs for yellow junction boxes contain sufficient details to identify the specific junction. I understand that the problem identified with the recent IT system change has been corrected and the actual locations of the box junctions can now be clearly identified from the information provided on the PCNs.
I would also like to confirm that the parking service changes its processes when required following key decisions by Adjudicators. This may also involve seeking additional clarification on matters from our own legal team, as we will from time to time get conflicting views from Adjudicators.
The point being made in earlier correspondence is that while we will make very effort to implement changes when Adjudicators criticise due process or raise points of law, one decision in its own right is not necessarily binding on other cases, for example with the Adamou v Haringey case, other adjudicators for a number of years before had found appeals relating to those box junctions in the Councils favour and raised no issue with the information on the PCN. However we do appreciate the significance of this case and aim to comply with the findings.
When considering the cancellation of penalty charge notices, decisions are made on the merit of the representations, statutory requirements, natural justice and where possible consistency with previous decisions. The service will not pursue payment of cases where there is no legal basis to do so, and similarly we will not cancel PCNs on technicalities where it can be avoided.
In respect of PCNs that may be issued in the future without precise box junction locations, (while every effort will be made to ensure that this does not happen) cases will be looked at on the basis of any other representation ( as mentioned above) and this may well result in cases being cancelled.
I hope that this response is helpful and now brings the matter to a conclusion.

and 13 August 2010 and that therefore dealing with Question 3, the number
of successful appeals to PATAS (from those tickets arising from q 1and 2)
and their grounds for appeal would be a small enough number for us to deal
with without incurring fees.
My response is as follows:
1. We did not issue any penalty charge notices with the location
specified as `Green Lanes' and `High Street' on the particular dates you
requested.
2. I am unable to confirm or deny that the description of the
location as given in q1 is still being used or not. From checking the
dates you requested it would appear not.
3. As no tickets were issued on those days with that description,
there are no records to check for appeal to PATAS.
I am happy to re-run reports if you would like a different location or to
specify alternative dates.
