PC Appeal No 70 of 1997
david schiller made this Freedom of Information request to Cabinet Office
Cabinet Office did not have the information requested.
From: david schiller
27 October 2009
Dear Sir/Madam
PC Appeal No 70 of 1997
In 1998 the Lord Chancellor chaired a judicial committee which
heard the above appeal
The Appellant was prosecuting the Case as a 'litigant in person'
and the Respondents (incl the A-G for Gibraltar) indicated the
Appeal would not be opposed
Shortly before the appeal was due and having been encouraged to do
so by the Privy Council, the Respondents changed their minds and
decided to oppose the Appeal
The Case has always had a political element to it and upon
'reaching' London it quite likely involved the Office of the Prime
Minister and/or other departments for which the Cabinet Office has
obligations under the Freedom of Information Act
If the Cabinet Office has any Information that touches at all on
the Case throughout its history and the Freedom of Information Act
applies I would request confirmation (or denial) that such
information is held and if held discovery of it
Sincerely
David Schiller

John Jenkins
Dear John
Thank you for the response and I note you have no relevant
information
I am in contact with the Ministry of Justice (on behalf of the
Privy Council Office) but they seem to have no information relative
to my request
The Case was in 1998 when the office of the Lord Chancellor was
somewhat different to nowadays
Its not always easy to keep up with the changes but I believe Jack
Straw is now the LC amongst other (things)
(as of todays date)?
If the MoJ are unable to assist with any discoverable information
under the FoI Act with regard to matters handled by Lord Irvine in
1998 is there any other government department that may be able to
help to your knowledge?
Regards
