Dear Architects Registration Board,

Please may I know on an annual basis since the Board was
incorporated under s.1 of the Architects Act 1997 how many
prosecutions there have been under Part IV of the Act in England &
Wales, in Scotland and in Northern Ireland that (a) have been
instigated by the Board or (b) have been instigated by others. If
your reply to (b) is positive, please inform me in each instance of
the party or organisation bringing those prosecutions. In each
instance, please let me know whether the prosecution succeeded.

As a separate inquiry may I also please know the cost to the Board
of the last three successful cases and the last three unsuccessful
cases. In each of these cases please let me know which side, if
any, was awarded costs and the amounts paid.

As a further separate inquiry, please inform me of the penalty
imposed on the guilty party in the last three successful cases.
Please let me know whether, and if so what proportion of these
penalties have been paid to the Board.

Dear Karen,

Thank you for your letter 29 July 2010.

I am grateful for the reference to the publicly available
information in answer to my first question. Please confirm whether
during the perod relevant to my request whether all the
prosecutions instigated by the Board, including any unsuccessful
proceedings, are listed there. If there are any that are not listed
then may I please have the information I requested in relation to
all of those cases.

Unfortunately you appear to have overlooked my second question,
namely:

"...may I also please know the cost to the Board of the last three
successful cases and the last three unsuccessful cases. In each of
these cases please let me know which side, if any, was awarded
costs and the amounts paid."

I would be grateful to have that information please.

Dear Mr Salisbury

The last three successful cases cost:

1) £3755. £1500 was awarded to the ARB in costs, none of which has yet
been paid.

2) £3478. £1000 was awarded in costs, all of which has been paid.

3) £2241. £1200 was awarded in costs, all of which has been paid.

All of the Section 20 prosecutions are listed on the website

I can confirm that there have been no unsuccessful prosecutions.
