Parking Ticket Data

Neil made this Freedom of Information request to Birmingham City Council

The request was successful.

From: Neil

7 August 2009

Dear Sir or Madam,

Under the Freedom of Information Act 2000 I would like to request
some information relating to the enforcement of parking
restrictions, specifically penalty charge notices.

1. I would like to request the raw data set of parking tickets
issued in the name of the council within the last five year period
broken down by: date, time, location, narrative of infraction,
current status of case, next status of case, transaction details
(ie. date, time and method of payments made), officer ID

2. I would also like to request any information regarding
‘reward’/bonus schemes/contracts in place for your parking
enforcement officers. This is envisaged to cover the details of any
systems, including (where bonuses are paid) the amount per officer
per year, for the last five years.

Regarding part 1. ideally I would like the location unit to be
'street' but if this is not practical then under your section 16
duty to advise and assist I would expect you to contact me to
discuss how you record this geospatial data so that I may narrow my
request in a way that works for both of us.

As a supplementary, under section 16, I would also ask that you
provide some detail about the recording processes of this parking
information. E.g. What software is used? What data fields are
recorded? What other data sets it links to, etc.

If this information is held by an outside contractor then it is
your responsibility under the FOIA to obtain that information.

If it is held by another public body then please can you inform me
of this and if possible transfer the request to that public body.
My preferred format to receive this information is by electronic
means. For both parts I would like the response to be in the form
of a raw text file, tab delimited, with text qualifiers where
required.

If you need any clarification of this request or if it is too broad
in any way please feel free to email me. If some parts of this
request are more difficult to answer than others please release the
answerable material as it is available rather than hold up the
entire request for the contested data.

If FOI requests of a similar nature have already been asked could
you please include your responses to those requests. I would be
grateful if you could confirm in writing that you have received
this request, and I look forward to hearing from you within the
20-working day statutory time period.

Yours faithfully,

Neil Houston

From: Neil

28 August 2009

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Birmingham City
Council's handling of my FOI request 'Parking Ticket Data'.

A full history of my FOI request and all correspondence is
available on the Internet at this address:
http://www.whatdotheyknow.com/request/pa...

The reason for the review, is that it has been stated that the
information is exempt under S21 of the FOI act. Though I do not
believe it should be rejected for such reasons, as I believe the
FOI they relate to mentioned 1 years worth of data, on a limited
set of fields.

Also the council have a duty under S16 to allow me to revise my
request, if the data for 5 years is not present, then surely we can
try and produce as much data that IS possible.

This is regarding the point 1. I accept the exemption for point 3.

Yours faithfully,

Neil

Dear Mr Houston

FREEDOM OF INFORMATION ACT 2000

I refer to your request for a review regarding question 1.

1. I would like to request the raw data set of parking tickets issued in
the name of the council within the last five year period broken down by:
date, time, location, narrative of infraction, current status of case,
next status of case, transaction details (ie. date, time and method of
payments made), officer ID

Please find enclosed spreadsheets on parking tickets raw data as far back
as we hold.

In respect of further data fields on narrative of infraction, current
status of case, next status of case, transaction details. I can confirm
that the department holds information that falls within the description
specified in your request, however, Birmingham City Council has estimated
that it will cost more than the appropriate limit to consider your
request.
The appropriate limit specified in the regulations is **450.00. This
represents the estimated cost of one person spending 18 hours in
determining whether the department holds the information, and locating,
retrieving and extracting the information. Consequently, the Council is
not obliged by the Freedom of Information Act 2000 to respond to your
request see section 12(1). The FOIA 2000 allows the first **450 of the
costs in obtaining the information of any request to be free to the
requestor, but any costs above that has to be paid by the requestor. The
above amount excludes any disbursement charges which would also apply,
i.e. photocopies at 0.15p per sheet.

To provide details of narrative of infraction, current status of case and
next status of case would require us to go through individual records and
strip out any data that would infringe patent/copyright with the third
party who provide the software that records parking data. Due to the
amount of records for the period requested and the officer time to produce
this information it would far exceed what we are required to do under FOIA
2000 (section 12). Therefore the Council will not be processing your
request further. This letter acts as a Refusal Notice.

If you are unhappy with the handling or the outcome of this request, you
are entitled to make a request for an internal review / appeal, such view
to be undertaken by Council officers not involved in the handling of your
request.

If you wish to take advantage of the internal appeal / review process,
this can be done by either contacting myself directly, or by contacting
the Corporate Information Manager at the following address quoting the

The Corporate FOI Unit
First Floor
1 Lancaster Circus

If, following the outcome of the internal review/appeal you are not
satisfied with Birmingham City Council***s response in relation to your
request, you are then entitled to apply to the office of the Information
Commissioner for an independent investigation/adjudication.

The Information Commissioner can be contacted by post at:
