Dear Sir or Madam,
The Reigate and Banstead Access Forum would like to know whether
the Board's proposal for charging disabled people for parking is to
go ahead.
We understand that it was challenged at the recent volunteers'
meeting; also that Janet Hall, PALS Manager and Geraldine Moll,
PALS Officer, have each stated in two separate Board meetings,
that:
"There are a lot of rich, disabled people".
Please can you also supply
(1)the statistics behind this claim, and
(2)copies of the minutes of these meetings.

Dear Jim,
Your ref: 0349
You did confirm that my FOI request about the parking policy was
being attended to and you also confirmed that I would be sent a
reply within the 20 days. However, by failing to do so no later
than 16th October, the Hospital Trust has now broken the law.
This FOI request was made on behalf of the Reigate and Banstead
Access Forum (http://www.fabrab.org.uk). Its officers and members
are still awaiting the response from you as named FOI Officer.
I see that there is another FOI request that dates back some time.

I have not yet received a reply to my FOI question dated 18th
September, even though you did acknowledge receipt and I have also
sent a reminder when the 20 working days had expired.
Having discussed the matter in full with the Equality and Human
Rights Commission, and also with specialist advice regarding Part 3
of the Disability Discrimination Act, clearly I have a legal
entitlement to the information on behalf of Reigate & Banstead
Access Forum, so I am requesting a written response from you within
the next 7 days.
Failing this, since you have exceeded the statutory limit I shall
be taking it up with the Information Commissioner's Office.
A copy of this message will be in the post to be sure that it is
received safely at East Surrey Hospital.

cannot be substantiated.

The Trust failed to respond to your request within the statutory time for
compliance, for which we sincerely apologise.
Our Approach to improvement
The combination of our need to recognise our internal procedural
deficiencies in our Freedom of Information requests handling and the
unacceptable levels of action taken to address them prompted:
o Appointment of a dedicated Freedom of Information Co-ordinator. Post
commenced 15^th October 2008 and is permanent and full time.
o FOI now falls within the remit of the Integrated Governance and
Quality team which provides support to this role and will ensure
contingency plans are in place in the event that the FOI Coordinator
is unavailable.
o Proactive monitoring of FOI requests and closures.
o Additional training to include "FOI - Staff Awareness Workshops" are
being designed and are scheduled for delivery early 2009.

Dear Sally,
Thank you for the response and the official apology.
It is difficult to understand the figures in the online format and
please understand that the website www.whatdotheyknow.com does not
publish any email addresses so that method you recommend for
complaints is not possible.
Certainly I was assured by the Information Commissioners Office
that I could decide to report the matter directly because the reply
was so late.
Regarding the PALS Manager Janet Hall and the PALS Officer
Geraldine Moll and their opinions that there are a lot of rich,
disabled people, I have today established - as a result of your
reply - that they were speaking at Volunteers meetings rather than
Board meetings. The original request should not have included the
word 'Board'. Please consider this as a new request under the
Freedom of Information Act. The Reigate and Banstead Access Forum
would still like to be informed of the statistics and evidence for
those statements. They were rather offended that hospital staff
thought like that.

In response to Part 2, please be advised that minutes are not taken at
"Volunteer" meetings.
However, comments made concerning disabled parking were found in the
minutes of the Equality, Diversity and Human Rights Steering Group meeting
held on 21st July 2008 and are recorded as follows:
"MH requested information on new disabled car parking arrangements and
understanding on how usage would be monitored. AM to supply. "
The Freedom of Information Act 2000 allows public access to recorded
information. It is understood that there was a discussion that being
disabled does not necessarily mean individuals are unable to pay the
standard parking fees.
Therefore we believe part 1) is not applicable.
This concludes your request. Please be assured that we have carefully
