Dear Sir or Madam,
In your response Reference: 46535 dated 17th February 2009 to my
previous FOI request your stated:
"(2) Each force Chief Constable owns the information they put onto
PNC for their force area. ACPO as a body represents all 44
individual forces in England & Wales and Northern Ireland, and
therefore is the representative owner of all PNC records."
I am making a follow up request under the Freedom of Information
Act 2000. I would like to know about ownership of data held on the
Police National Computer
(PNC). Please would you provide the following information:
(a) what is the legal/statutory basis for stating that each force
owns the data, e.g. records of convictions which are records of
successful prosecutions;
(b) what is the legal/statutory basis for stating that ACPO is the
representative owner - ACPO is a limited company, please explain
how it acquires "representative" ownership of sensitive public
records.
