Dear Sir or Madam,

Please pass this on to Director of the Cabinet Office Sue Gray.

I am writing to request an internal review of Prime Minister's
Office's handling of my FOI request 'Oversight by the Prime
Minister of his Special Advisers'.

The initial reply was a copy of the letter that the Prime Minister
sent to Sir Gus O'Donnell requesting changes to the current code.
However this did not answer my query at all, which was what actions
the Prime Minister had taken over a certain period to ensure
compliance with the code that existed in that period by his Special
Advisers.

Dear Sir or Madam,

I calculate that it has now been over 20 working days since my
request for an Internal Review, made on 13 May 2009. I have had no
substantive reply to my request. Why not? When can I expect to
receive a substantive reply?

Noting that the Information Commissioner's guidance states that a
reasonable time for such a review is a maximum of 20 working days,
other than in exceptional circumstances please can you also outline
the exceptional circumstances that you feel apply.

Dear Sir or Madam,

After more than 40 working days I have received no substantive
response to my request for an internal review of my FoI request
(your reference FOI264434).

You'll be aware that the Information Commissioner's Good Practice
Guidance states:
"In no case should the total time taken [for an internal review]
exceed 40 working days. In such cases we would expect a public
authority to be able to demonstrate that it had commenced the
review procedure promptly following receipt of the request for
review and had actively worked on the review throughout that
period."

When can I expect to receive a response to my request for an
internal review?

Dear Sir or Madam,

After more than 40 working days & one previous reminder I have
STILL received no substantive response to my request for an
internal review of my FoI request(your reference FOI264434).

You'll be aware that you are now in breach of the Information
Commissioner's Code of Practice and, I believe, may have caused
individual civil servants to be in breach of section 5 of the Civil
Service Code which forms part of their terms & conditions of their
employment.

Unless I receive a full response very promptly I will take this
matter further.
