The request was refused by Southampton City Council.

From: stephen nash

24 November 2009

Dear Sir or Madam,

I am writing to request information under the Freedom of
Information Act 2000, I am outlining my query as specifically as
possible.

1. For the last year the total amount spend on outside legal
advice?
2. The name and address of those provided the advice and how much
was paid to them and to which departments they were provided advice
to?

I would be interested in any information held by your organisation
regarding my request. I understand that I do not have to specify
particular files or documents and that it is the department
responsibility to provide the information I require.

I would like to receive the information in hard copy format

If my letter is denied in whole or in part, I ask that you justify
all deletions by reference to specific exemptions of the act. I
will also expect you to release all non exempt material. I, of
course, reserve the right to appeal your decision to withhold any
information or to charge excessive fees.

I would be grateful if you could confirm in writing that you have
received this request. I look forward to your response within 20
working days, as outlined by the statute.

Regards

Yours faithfully,

Stephen Nash

Dear Southampton City Council,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Southampton City
Council's handling of my FOI request 'Outside legal advice'.

I wish you to review the redacted you have had under the data
protection act- i refer you to the case of Durrant V Financial
Services Act i which the Court concluded that personal data is
information that affects a person privacy, whether in his personal
or family life, business or professional capacity. so
identification alone no longer guarantees that data is personal. it
must also effect the named person privacy. I also refer you to the
information Commissioner guidance in which he stated Information
which is about the home or family life of an individual his or her
personal finances or consists of personal references is likely to
deserve protection. By contrast information which is about someone
acting in an official or work capacity should be normally be
provided on request unless there is some risk to the individual
concerned.

A full history of my FOI request and all correspondence is
available on the Internet at this address:

Yours faithfully,
