Can you please inform me of how many officers who have been on
secondment have;
Been returned to force for disciplinary investigation?
The agency or force they were seconded to?
The nature of the investigation?
If it was a criminal allegation, was the case considered by The
Crown Prosecution Service?
If finalised the outcome?
Are the officer's still serving, retired, dismissed or resigned?

Could you please look at the years 2007 to date please.

Dear Sir

FREEDOM OF INFORMATION ACT REQUEST REFERENCE NO: 181/10

I write in connection with your request for information dated 25^th
February 2010 made to British Transport Police. I note you seek access to
the following information:

Can you please inform me of how many officers who have been on secondment
have;

Been returned to force for disciplinary investigation?

The agency or force they were seconded to?

The nature of the investigation?

If it was a criminal allegation, was the case considered by The Crown
Prosecution Service?

If finalised the outcome?

Are the officer's still serving, retired, dismissed or resigned?

British Transport Police have considered your request and have decided in
accordance with duty placed on BTP by Section 1 of the Freedom of
Information Act 2000 to neither confirm or deny that it holds the
information you have requested.

To give the reasons why neither confirming nor denying is appropriate in
this case would itself involve the disclosure of exempt information,
therefore under section 17(4), no explanation can be given.

To the extent that section 40(5) Personal Information applies, British
Transport Police has determined that in all the circumstances of the case
the public interest in maintaining the exclusion of the duty to neither
confirm nor deny outweighs the public interest in confirming whether or
not information is held.

As laid down in the Freedom of Information Act 2000 you have the right to
ask British Transport Police to carry out an internal review if you are
not happy with the reply you have received. Should you wish to invoke
such a review please make you request to me stating what you would like
BTP to review the decision. Although there is no set timescale laid down
in the Act for internal reviews, BTP aim to respond within 20 days,
however, in more complex cases this may take longer. If this is the case
you will be advised of the likely timescales involved.

If after the review is complete you are still not happy with BTP's
response you will then have the right to lodge a complaint with the
Information Commissioner's Office.

I am considering an internal review. You publish in your Annual
Report discipline statistics and rank. This is actually what I am
asking for.
Is there any information surrounding my request that you feel you
can answer?
