I read in the Evening Standard that 11-year-old girl, Elliz
McKenzie, from Dulwich had been offered community service as a
sanction before being re-issued with an Oyster Card.

Please provide information on:

- How many under-16s have been threatened with community service in
this manner since the introduction of 11-15 concessionary travel.

- How many under-16s have undertake community service on your
behalf in this time.

- TfL's full policies regarding Oyster Card confiscation, the
withdrawal of concessions and the sanctions required to requalify.

Dear Mr Griffiths

Thank you for your email received by Transport for London (TfL) on 16
February 2010. You asked for information concerning the Evening Standard
article on Elliz McKenzie, namely the Earn Your Travel Back scheme.

Your request has been considered under the requirements of the Freedom of
Information Act and I can confirm that TfL does hold the information you
require. This I have detailed below.

The answers to the questions you made are provided in the order you asked
them. Additional information has also been provided on the scheme in
place, to which your request relates.

1. How many under 16s have been threatened with community service in
this manner since the introduction of 11-15 concessionary travel?

Ms McKenzie was not given community service. Transport for London (TfL)
gave her the opportunity to participate in the Greater London Authority
(GLA) initiative, ***Earn Your Travel Back*** (EYTB). This is undertaken
on a voluntary basis and is not compulsory. Ms McKenzie was not
threatened, and nor have any other individuals.

2. How many under 16s have undertaken community service on your behalf
in this time?

As stated in (1), this is not community service. From the initial pilot
of the EYTB initiative on 9 August 2009 to 17 February 2010, TfL has
offered opportunities to 1,937 individuals aged 11-15 and 16+ Zip free
travel concession holders to earn their free travel concession back. So
far 286 Zip free travel concessions have been reactivated as a result of
successful participation in the scheme. Further, 34 participants either
failed to attend or satisfactorily complete the EYTB day and have
therefore not had their concession reactivated.

3. TfL***s full policies regarding Oyster Card confiscation, the
withdrawal of concessions and the sanctions required to re-qualify.

All Zip Card holders have to abide by the Behaviour Code, it is a
condition of their free travel concession. If they act in breach, then
the Zip card can be confiscated. I have attached the Behaviour Code to
this email for your reference.

If a card becomes damaged then this should be reported promptly to the TfL
Oyster helpdesk and a replacement card requested. The photo cards are key
to reducing anti-social behaviour on buses, therefore, the photo on each
card has to be clearly visible.

Concession holders whose cards have been withdrawn are offered the
opportunity to either participate in the EYTB initiative, or to appeal
against the withdrawal.

The appeals process has three stages. The first two are managed
internally by TfL. The third and final stage is undertaken by an
Independent Appeals Panel (IAP) nominated by London TravelWatch. The IAP
makes their decision independent of TfL and their decision is final and
binding on TfL

In terms of EYTB, The National Young Volunteers Service deliver this
scheme. They arrange for young people to take part in a day***s work for
either The London Wildlife Trust (LWT) or the British Trust for
Conservation Volunteers (BTCV). For more information please visit the

However, those individuals who have had their Zip card confiscated are
able to obtain discounted travel with a non-concessionary version of the
Oyster photocard. These fares are currently capped within zones 1-6 at
**1 per day for bus journeys, as stated in the Terms and Conditions for
