Dear Lynn Daley,

1. Number of electively home educated children known to your LA.

I regret I am unable to service your request in its present form, as I
require further information from you.

Please can you supply a time frame for your request i.e. the last academic
year or the last 12 months as an example.

Q3: please can you clarify if you mean total population of children in our
LA, Education or Social Care?

you.

The normal time limit for responding to a request for information, under
the Freedom of Information Act is 20 working days from the day after it is
received. However, where an authority reasonably requires further
information or clarification before it is able to respond to a request,
section 10(6)(b) of the FOIA specifies that the 20-day period for
compliance with the request begins when the authority receives the
information it requires to identify and locate the information requested.

The City Council would like to make you aware that if we do not receive

Act, whether it is in the public interest to release the information. If

There may be a fee payable for this information and you will be informed
if this is the case. Any fee must be paid before the request is processed
and the information released. The 20 working day time clock will stop
until the fee is paid.

FOI INFORMATION REQUEST – Elective Home Educated Children

Thank you for your request for information received on 2 July which was considered under the Freedom of Information Act 2000.

In accordance with FOIA Portsmouth City Council confirms it holds the information. Please see below each of your questions, together with our response:-

1. Number of electively home educated children known to your LA.

44 (this is for the period 1/9/08 to 13/7/09)

2. Number of electively home educated children who have a care plan in place due to concerns of abuse.

The senior manager responsible for Children Services has provided the following response: “The number of children involved in both ELE as well as who meet the description in the request is so small that there is a risk of breaching the child(ren) and family's rights under Data Protection and Human Rights Acts."

Accordingly PCC has engaged FOI exemption s40(3) – personal data, where disclosure of that data would cause PCC to breach one of the Data Protection principles. PCC believes that Principle 2 would be breached as the data was processed by PCC for the purposes of providing a service to that family and child(ren) and not for onward processing by a third party.

In accordance with the Freedom of Information Act 2000, PCC confirms that it holds the information but under s17 (Refusal of a request) this part of your request is refused and the s40 exemption applied.

3. Total number of all children in your LA

38,100 (age 0-17) - mid year 2007 estimate which is the latest published figure.

4. Total number of children who have a care plan in place due to concerns of abuse.

Number of Child Protection Plans in place in the period 01/09/2008 - 13/07/2009 (this matches the period used for the home education cohort) = 395
