I am advised by the Electoral Registration Office that there is no such
thing as a 'Notice of Poll' for a Parliamentary Election, there is only
a 'Notice of Election' and then a 'Statement of Persons Nominated and
Situation of Polling Stations Notice'.

Dear Mr Watson,

I have now confirmed that the Council is only required to retain these
records for 12 months. However, we do hold the Statement of Persons
Nominated for the Parliamentary Election on 5th May 2005. For 7th June
2001, and for 1st May 1997 (which was prior to the formation of West
Berkshire Council) we only hold the Parliamentary Election results
(candidates and votes cast).

I have copies of all these documents (they are not held electronically)
and can supply them by post if you provide a mailing address.

Dear Mr Watson,

Unfortunately my computer is not linked to a scanner. One page is A4,
the other two are A3 pages. The Act states that "Where the public
authority determines that it is not reasonably practicable to comply
with any preference expressed by the applicant in making his request,
the authority shall notify the applicant of the reasons for its
determination". Section 11(3). In this case we have already taken some
time extracting these from our archives, and it is not reasonably
practicable to take additional time seeing if I can get these scanned by
Planning Services, and then arranging for the scanned documents to be
emailed across.

If you don't want to publicise your address on the What do they Know
website, which I can quite understand, you can send me an A4 envelope
with your address and a covering note. We will pay postage.

Dear Sue Broughton,

I am sorry to hear that getting the three documents scanned by the
Council will cause this request to exceed the cost limits laid down
by the Act.

In order to try to assist I can offer you the use of my scanner. In
fact, I can come round and install it and scan the documents for
you.

The train fare is only £9 return off-peak, which I will even stump
up myself, and I won't charge for my time.

Dear Sue Broughton,

My mistake, I thought that, when you referred to the time spent in
the archives and then to the prospect of having to spend more time
having the documents scanned, your citation of Section 11(3) must
have been determined on the cost implications of that time.

If it is not a matter of cost, as you now state, and given that you
have been offered the means to provide an electronic copy, then can
you please state the exact nature of the impediment to your
satisfying the obligation under Section 11(1) ?
