Dear Mr Hart
Your FoI request concerning the above case has been passed to me as the
Council's senior legal officer. The claim brought by Mr & Mrs Beyers was
for compensation under s.203 Town and Country Planning Act 1990. The claim
was settled by negotiation without the need for a Lands Tribunal Hearing.
The terms of the settlement are covered by legal professional privilege
and therefore exempt from disclosure under s.42 Freedom of Information Act
2000. I am of the view that the public interest test is satisfied by
non-disclosure as it is important that negotiating tactics employed by the
Council in reaching settlements is not put into the public domain as it
may prejudice attempts the Council may wish to take to negotiate
settlements in future cases. There is a further general public policy
issue that without prejudice negotiations which result in the settlement
of a dispute should not be put in the public domain.
If you are dissatisfied with my response you may complain to the Chief
Executive, Mr John Mitchell. He will appoint a director to investigate
your complaint. If you remain dissatisfied you may complain further to Mr
Mitchell who will review the handing of your complaint. If you are still
dissatisfied at that stage you may complain to the Information
Commissioner. Details as to how to do this will be supplied at that stage.
