Dear Royal Borough of Kensington and Chelsea,
I have just come across a website that shows a picture of one your
permit-only motorcycle parking bays which appears to be missing
locking ground anchors. The bay is located in Penywern Road, London
SW5.

According to your own website, "all permit-only designated
motorcycle bays are now provided with locking ground anchors".
In the light of the above, please would you:-
1. explain why this particular bay, which is reserved to bikers
with parking permit, has not been equipped with locking ground
anchors at the time of writing.
2. advise the exact date when this bay was created for motorcycle
permit holders only. If the bay was first created for visitor use
and then converted into a permit-only bay, please advise the date
of creation of the bay for visitor use and the date when it became
a permit-only bay.
3. explain the reason why your website states that "all permit-only
designated motorcycle bays are now provided with locking ground
anchors", when clearly this is not the case.
4. advise whether it is your intention to install locking ground
anchors in this bay and the date when we can expect to see some
installed. If it is not your intention to install locking ground
anchors in this bay, please explain your reasons in the light of
the statement shown on your website.
5. advise whether it is your intention to remove locking ground
anchors from permit-only bays or create new permit-only bays
without locking ground anchors. In either case, please explain your
reasons.

Dear Mr Jones,
Thank you for your email.
1. This is a newly installed bay, re-positioned at the request of local
residents from Eardley Crescent, where it was rarely used to Penywern
Road. Before we decide to introduce ground anchors, which are expensive to
install, we are monitoring usage of the new bay.
2. The bay was introduced on 12 April 2010. Previously it was a Blue
Badge disabled bay.
3. Our website was incorrect. Most motorcycle permit bays are provided
with ground anchors. The website has now been changed.
4. No decision has been made on whether to install ground anchors at
the Penywern Road location. Please see reply to question 1. above.
5. We have no intention of removing ground anchors from motorcycle
permit bays. We could create new motorcycle permit bays without installing
ground anchors.

Thank you for your response to my FOI request.
I would like clarification on two points which I have picked up
from your response:-
A. Point 1. of your response says "before we decide to introduce
ground anchors, which are expensive to
install, we are monitoring usage of the new bay".
Please can you explain why this bay requires a permit while it
doesn't have security devices. You have always explained that the
whole point of charging is to fund the cost of security devices and
thus provide a value added service to residents. So since this bay
doesn't currently have security devices and offers no additional
benefits compared with visitor bays, why do you need to charge for
it? Why can't you monitor its usage without charging? On what basis
do you expect residents to pay for motorcycle parking in a bay that
offers absolutely no additional benefit compared with visitor bays?
B. Point 5. of your response says "we could create new motorcycle
permit bays without installing ground anchors".
Please provide reason(s) why you feel the need to charge residents
for parking in those bays given that you would not have spent a
penny in the installation of ground anchors, which you have always
said represent an additional benefit that justifies a charge. What
do you need to recover costs for in this particular instance?

Dear Mr Jones,
Thank you for your email.
We have introduced ground anchors at around 130 of the 140 or so
motorcycle permit bay locations. The cost of this was substantial. Until
we know if a new bay is regularly used we are refraining from introducing
ground anchors. The residents' motorcycle permit enables the holder to
park in all permit bays, not just a specific bay. If we converted the bay
in Penywern Road to a solo motorcycle bay it would probably attract
visitor motorcyclists, and possibly large numbers of them, but we are
trying to persuade residents to routinely use the residents' permit
motorcycle bays. Residents need to know that they have a bay fairly close
to their homes that they can regularly gain access to. There is a solo
motorcycle bay located at the other end of Penywern Road that can be used
by visitors.
We set up the residents’ motorcycle permit scheme to encourage residents
with motorcycles to park in dedicated bays rather than in solo motorcycle
bays or residents’ parking bays. This should have made better use of
kerbside space. This was done after consultation with residents. We
expected that two years after the introduction of the new residents’
motorcycle permit bays a significant migration of resident motorcyclists
to the residents’ motorcycle permit bays would have occurred. This has
only happened in parts of the borough. We are aware that some of the
residents’ permit motorcycle bays are infrequently used or in some cases
remain completely empty (most of the latter bays have anchor devices).
This is why we are cautious about introducing more expensive ground
anchors. Unfortunately, the majority of resident motorcyclists are
continuing to park in residents’ parking bays or solo motorcycle bays.
Within the next few weeks we will be discussing possible solutions with
the elected Members. How we deal with the empty residents’ motorcycle
bays and the cost of the permit will be two key areas for discussion.
We do not charge for parking in specific residents' motorcycle bays,
rather for membership of the motorcycle permit scheme. This enables
motorcyclists to park in over 140 bays throughout the borough, the vast
majority of which have anchor devices. The locations without anchor
devices tend to be those where we have had problems physically introducing
them or more recently where we have been asked to move the bay and are
uncertain if the new location will appeal to resident motorcyclists.
