Dear Sir or Madam,

I would appreciate copies of all monitoring officer reports issued
by the Christchurch Borough Council following admission and or
agreement by the Christchurch Borough Council that they had
committed
maladministration causing injustice, as evidenced through an local
settlement agreed with the Local Government Ombudsman, as well as
any monitoring officer report produced following a formal finding
of maladministration and injustice by the Local Government
Ombudsman for the last six years.

If a monitoring officer report has not been produced in relation to
each individual settlement, I should appreciate clarification if
the Council rejected both the Ombudsman's findings and their
recommendations in relation to each local settlement agreed, and
copies of all associated documentation for the last six years.

Many thanks for your email (attached).

I would anticipate that the Council should know if a Council has
either rejected or renaged on an Maladministration finding by the
Local Government Ombudsman as Monitoring Officer... due to the acts
of the officers..

In the last four years (the length of time that you retain records
(Local Government Ombudsman letters) - contrary I understand to the
guidance of the records society of GB) Christchurch Council has it
appears agreed 5 Local Settlements (10 between 1998 and 2008).
There have been no formal reports issued over the last four years..
However.. over the last ten years there appear to have been seven
issued.

The reason for the questions are very straightforward.. There
appear to be data retention problems amongst Council's related to
Complaint Files.. Common Practice by English local authorities is
retention for 10 years (however.. in most cases the contents don't
match those of the LGO).

A report is being produced in relation to data retention, accuracy
of retention, compliance with FoI.. etc..

and as you have already identified that you have not produced a
monitoring officer report I would anticipate that this followed
discussions with the Head of Paid Service and s151 Officer.

I'm sure that you have already checked the LGO's annual letter and
observed the response times of Christchurch to forward copies of
about 16 Complaint files to the LGO over the last three years has
taken about 440 days..

You are a lot better than some.. but does not negate the role of
Monitoring Officer.
