Dear Sir or Madam,

When the LGO or the CLAE on their behalf investigates a complaint
and corresponds with a Council on how many occassions over the last
3 years has the CLAE and/or LGO corresponded with a Council's
monitoring officer to ensure that the reply is based on full
disclosure, and that the documents are properly authenticated, and
that the Monitoring Officer makes the Council aware of all
admissions of mI through a report as required.

Please detail this information by Council, and Ombudsman's Office.

Dear Foi Officer,

The issue of Mr KARNEY is with the ICO.

In relation to the request. It appears reasonably straightforward
that the CLAE would ensure that they only corresponded with a
Council's monitoring officer due to the provisions of the Local
Government and housing Act 1989.

Any decision not to correspond with the Monitoring Officer by the
CLAE would be a dicretionary decision, and would enable a Council
to subvert an investigation. The questions allows this to be
identified, as well as identification if the CLAE have adequate
procedures in place

Dear Foi Officer,

Many thanks for your reply. I can understand the application of s44
to a complaints file.

However, what I am actually looking to know is does the CLAE have
any procedures as to who to contact in a Council..

i.e.. only communicate through monitoring officer.. only
communicate through Chief Executive.. etc..
