Freedom of Information Act 2000

I am writing to advise you that, following careful consideration, the Agency has decided not to release the information which you requested on 3 October 2008 as it falls within the terms of exemption under Section 40 of the FOI Act which relates to personal information.

This means that we are required to respond within the terms of the Data Protection Act 1998, and not the Freedom of Information Act. Section 7(4) of the Data Protection Act does not oblige us to release information which would identify another individual.

The Agency has concluded that as there was only one case of a mark being withdrawn as a result of the offence of misrepresenting a registration mark being committed, to release this information might identify the driver.

If you are unhappy, you have the right to seek a review of this decision by the Department in the first instance, within two calendar months of the date of this letter. If you wish to do so, please write to

Dear Moore, Sylvia,

Thank you for your response to my request.

As you are unprepared to respond giving full details I would wish
to amend my request thus.

rather than listing the marks that have received warnings I wish
you to state simply the figures involved.

Could you please state how many number plates have been withdrawn
by dvlni

could you please break down how many people the dvlni has written
to to warn them about their registration marks?

How many reports have been received more than once for each mark?

Finally please provide a break down of how the reports relate to
the persons reporting them?

ie how many withdrawn following complaints from MPs. how many
following reports from staff etc.

I am writing to confirm that the Agency has now completed its search for
the information about statistics for letters regarding misrepresented
registration marks which you requested on 27 October 2008. Between
August 2006 and October 2008 the information is as follows:

Number of number plates withdrawn by DVA
- 1
Number of warning letters issued
- 521
Number of reports received more than once for each mark (9 with 2
reports and 1 with 3 reports) - 10

Number of reports received from PSNI
- 521

There were no registration marks withdrawn following complaints from
MPs or staff.

The information supplied to you continues to be protected by the
Copyright, Designs and Patents Act 1988. You are free to use it for your
own purposes, including any non-commercial research you are doing and
for the purposes of news reporting. Any other re-use, for example
commercial publication, would require the permission of the copyright
holder. Most documents supplied by Driver & Vehicle Agency will have
been produced by government officials and will be Crown Copyright. You
