Dear Sir,
Thank you for your e mail of 11 December 2008 and your request under the
Freedom of Information (FOI) Act for information relating to the Charity
Commission's investigation into the affairs of the above charity in 1997.
I would clarify that the Commission's file retention policy means that
after a period of five years after the closure of the Commission's
operational casework our paper records are destroyed. Therefore, given the
timeframe of the investigation you refer to i.e. 1997 we no longer hold
any paper records and are therefore unable to provide you with any paper
file related information which was previously held.
However, the Commission does hold some very limited information on the
investigation you refer to within its archived electronic records. I have
provided this information below but as some of this information relates to
personal data this has been edited to remove reference to personal
information as it is subject to the exemption contained within section 40
of the Freedom of Information Act.
The Commission's investigation was conducted under case number 8132 and
was first opened on 17 October 1994. The case was closed on 20 April 1998.
The issues on this case were stated as being fraud and malpractice. The
last action taken by the Commission is stated as being a letter dated 20
April 1998 and was to confirm that an individual was still suspended and
that the charity was to be wound up. The Commission's records show that
the charity was removed from our register on 21 April 1998.
If you are unhappy with our response to your FOI request, have a complaint
or wish to request a review of our FOI decision, you should write to:

what it is you are dissatisfied with, which will assist us when we review
our response.
