Dear Sir or Madam
Please provide the following information relating to
the above bus operator:
(1) Please provide confirmation of the number of complaints and the
nature of complaints made to SPT regarding the above operator,
(2) Please provide details of any fraudulent activity/concerns
regarding the above operator and the abuse of the concessionary
travel scheme in Scotland,
(3) Please confirm if the above operator receives a subsidy for
driving vehicles from Glasgow/Greenock and Greenock/Glasgow and if
payment is made to cover driving the vehicles on a non-standard
road surface just outside Bishopton,
(4) Please confirm if the operator is subject to any/or has been
subject to any sanction, chargeback or fine in relation to
providing its service.

Dear Sir/Madam,
In respect of the above request Transport Scotland only hold
information in respect of question 2 in your list and respond to it as
follows;
Question:- "Please provide details of any fraudulent activity/concerns
regarding the above operator and the abuse of the concessionary travel
scheme in Scotland"
Answer:- The Concessionary Travel and Integrated Ticketing Unit of
Transport Scotland are responsible for managing reimbursement payments to
bus operators within the National Concessionary Travel Scheme in Scotland.
All claims for reimbursement are validated in the same way. These
processes are controlled by our Fraud Response Plan which directs that
where we have evidence of fraud we would make an allegation to the police
for investigation. It also directs that where a fraud is suspected we
would not speak to any third party about this. All abuses of the Scheme
are dealt with within our Fraud Response Plan.
Question 1 makes reference to SPT and should therefore be directed to
Strathclyde Partnership for Transport
Question 3 asks about payments for driving buses on non standard road
surfaces. If there is such payment it is not within the remit of Transport
Scotland.
Question 4 asks about sanctions, chargebacks or fines in relation to this
operator providing it's service. Again this is not within the remit of
Transport Scotland however the Office of the Traffic Commissioner may be
able to assist.

Dear Sir/Madam
Thank you for your letter dated 19th October 2009. I have been requested
by David Middleton to carry out a review of our response to your request
under the Freedom of Information (Scotland) Act 2002 (FOISA) for details
of fraudulent activity by McGill's Bus Services Limited. I have been asked
to carry out the review because I was not involved in handling your
original request, and I will be looking at the case afresh to establish
whether the original response should be confirmed, with or without
modifications as appropriate, or a fresh decision should be substituted.
I will review the case on the basis of your request for review and contact
you within 20 working days of your request being received with my
decision. A response will be issued on or before Monday 16th November
2009.
