Subject: Freedom of Information request - Mayor's Visit to Merton

The Mayor would like to thank you for your interest in his work and he is
keen to answer your query as quickly and fully as possible. As you will
appreciate, he receives very large amount of correspondence but he is
committed to responding to your query within 20 working days.

However, the Greater London Authority (GLA) will only respond to queries
that relate to its work and will refer relevant queries to the appropriate
functional body for them to reply e.g. transport related queries will be
referred to Transport for London (TfL).

Please note that the GLA does not accept unsolicited job applications or

I refer to your email of 5 October 2009 requesting the following information:

A copy of the information the GLA holds that falls within the scope of your request, and can be disclosed, is attached.

A small amount of information caught by the request (names, email addresses and contact details of junior or non-public-facing GLA staff) is exempt from disclosure under section 40(2)(a)(i) ('Personal information') of the Freedom of Information Act and is therefore being withheld. Details of the reason for this are set out in the Annex below.

s. 40 Personal information
Section 40(2) Any information to which a request for information relates is also exempt information if-
(a) it constitutes personal data which do not fall within subsection (1), and
(b) either the first or the second condition below is satisfied.

The first condition is-
(a) in a case where the information falls within any of the paragraphs (a) to (d) of the definition of "data" in section 1(1) of the Data Protection Act 1998, that the disclosure of the information to a member of the public otherwise than under this Act would contravene-
(i) any of the data protection principles.

Names, email addresses and contact details of junior and non-public-facing GLA staff that are not in the public domain constitute personal data which is defined by s.1(1) of the Data Protection Act 1998 to mean data which relates to a living individual who can be identified from that data.

It is considered that disclosure of this information would contravene the first data protection principle, which states that "Personal data shall be processed fairly and lawfully and, in particular, shall not be processed unless -

(a) at least one of the conditions in Schedule 2 is met, and
(b) in the case of sensitive personal data, at least one of the conditions in Schedule 3 is also met."

It is considered that none of the conditions which allow the processing of the information apply in this case, as the individuals concerned (junior/ non-public facing GLA staff) have not consented to disclosure of their names and contact details and it is not within their expectation that such details would be disclosed in the course of carrying out their job. It is therefore considered that disclosure of such information would not be a fair and lawful use of junior/ non-public facing staff names and work contact details. Information Tribunal appeal EA/2007/0072, dated 29 April 2008, supports the use of this exemption for withholding names of employees that are not in senior/ public-facing positions.

Names of senior staff and junior staff in public-facing roles are being disclosed.

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Greater London
Authority's handling of my FOI request 'Mayor's Visit to Merton
01/10/09'.

The redaction of names (both as email addressees and in email
signatures) on pages 123 and 124 of the pdf is inconsistent with
the redaction applied elsewhere in the document (the name of the PA
to the Leader of Merton Council is not redacted elsewhere). Given
the context of the emails, I also do not believe that the names in
question are those of 'of junior or non-public-facing GLA staff'
(the grounds given for non-disclosure). I trust that you will be
able to release a revised version of the email chain with the
redaction removed.

Internal review

Thank you for your email of 16 November 2009 requesting an internal review of this FOI request.

In line with the GLA's procedures, I have now conducted a review of your complaint.

We apologise that the redaction on page(s) 123 (and 124 check) is inconsistent with the redaction applied elsewhere in the disclosure document due to administrative error.

Please find attached a revised version of the disclosure document with the errors in redaction removed.

We trust this deals with your complaint. However, if you remain unhappy with the outcome of the internal review, you have the right to apply directly to the Information Commissioner for a decision.
