Mayor of London Transport Strategy - Consultation Process - Very few aware within LB Croydon

Dear Croydon Borough Council,

It has become apparent that many organisations and members of the
public in LB Croydon were not aware of the recent consultation into
the Draft Mayor of London Transport Strategy.

Please explain the steps that Croydon Council took with TfL to make
the public aware of consultation into the Draft Mayor of London
Transport Strategy.

(1) What publicity was undertaken across LB Croydon by TfL and by
LBC?

(2) What was published that explained the Draft Strategy and the
consultation process and how were these made available?

(3) What steps were taken to try to ensure a balanced cross-section
of the public was made aware of the process?

(4) Where were leaflets distributed, and how was this decided?
What analysis suggested this would lead to a fair and balanced
distribution across the community?

(5) What steps were taken to ensure that hard-to-reach sections of
the community, such as those who travel exclusively by private car,
were made aware of the consultation process and encouraged to
participate in it?

(6) What consultation discussions took place between LBC and TfL
over how this process would operate?
To what extent was the council consulted over the detail of the
consultation, and what views did it express?

(7) Is the council happy with the consultation process?
Was the council happy that the online questionnaire was so
flagrantly biased?
Was the council happy that were responders allowed to pick as many
as they chose from an uncosted wish-list?

(7) What steps were taken to inform and involve organisations
likely to have an interest?

(8) What programme of meetings was organised?
Did Croydon Council ask TfL to attend meetings of the council's
Neighbourhood Partnerships, and how many did receive reports on the
consultation from TfL?

(9) How many meetings took place within LB Croydon between TfL and
the council as part of the consultation process?
What about with local groups in LBC?

(10) What pre-consultation took place with interested parties to
ensure that the process was fair and balanced?

(11) Does the council support a MTS consultation on the Draft Mayor
of London Transport Strategy that offers so little for the driver -
private motorist or professional driver of taxi, minicab, van,
lorry or bus?
How important are private drivers in the overall use of transport
in Croydon?
Has the council expressed concerns over this unfair and unbalanced
aspect of the consultation process?

(12) Does the council support a MTS in which the promotion of
cycling within the draft MTS does not also include warnings on the
dangers of this mode?
Does the council support the proposition that a mass switch to
cycling would be beneficial justified, and on what evidence?

(13) Does the council support a MTS consultation in which costings
of various suggestions were not put forward, so that the public
could see how much tax each would entail?

(14) Does the council support a MTS consultation in which there was
no question on the level of subsidy that each mode should receive?

(15) Does the council support a MTS consultation in which no
question is asked as to whether the users of a mode should bear
all, most, some or whatever proportion of the costs of providing
that mode?

(16) What representations has or will the council make regarding
the consultation process into the Draft MTS as a result of this
enquiry or otherwise?

Dear Ms. Black,

Further to your email dated 15 January 2010, in which you have requested
information in respect of, the Mayor of London's Transport Strategy and
consultation process, we have considered your request under the terms of
the Freedom of Information Act (FoIA) 2000 and are able to supply you with
the following information in response to your questions 1 to 15 below:

(1) What publicity was undertaken across LB Croydon by TfL
and by LBC?

o Other than direct consultation with the Council, the only publicity
undertaken by Transport for London (TfL) that I have been informed of
was a consultation stand organised and staffed by TfL in the Whitgift
Centre (central Croydon). The Council's response to the draft Strategy
followed consultation with elected members.

(2) What was published that explained the Draft Strategy and
the consultation process and how were these made available?

o The information regarding this question and questions 3, 4, 5 and 7 is
not held. It is assumed that TfL would hold this information and in an
effort to provide assistance their Information Access & Compliance
Team contact details are provided below:

(3) What steps were taken to try to ensure a balanced cross-section of the
public was made aware of the process?

o See reply to question 2 above.

(4) Where were leaflets distributed, and how was this decided? What
analysis suggested this would lead to a fair and balanced distribution
across the community?

(5) What steps were taken to ensure that hard-to-reach sections of the
community, such as those who travel exclusively by private car, were made
aware of the consultation process and encouraged to participate in it?

(6) What consultation discussions took place between LBC and TfL over how
this process would operate? To what extent was the council consulted over
the detail of the consultation, and what views did it express?

o There were no discussions between Council and TfL on consultation
strategy

(7) Is the council happy with the consultation process? Was the council
happy that the online questionnaire was so flagrantly biased? Was the
council happy that were responders allowed to pick as many as they chose
from an uncosted wish-list?

o The Council is not aware of the full extent of TfL's consultation
process/strategy and therefore is unable to comment on this.

(7) What steps were taken to inform and involve organisations likely to
have an interest?

o See reply to question 2 above.

(8) What programme of meetings was organised? Did Croydon Council ask TfL
to attend meetings of the council's Neighbourhood Partnerships, and how
many did receive reports on the consultation from TfL?

o There were no meetings organised by the Council with members of the
public/neighbourhood partnerships. The Public Draft Mayor's Transport
Strategy was published for consultation by the Mayor of London in late
October 2009. Given the tight timetable for responding to the
strategy and the need to meet the various internal Council approval
processes, there was insufficient time for the Council to conduct an
external consultation exercise to supplement the consultation
undertaken by the Mayor of London.

(9) How many meetings took place within LB Croydon between TfL and the
council as part of the consultation process? What about with local groups
in LBC?

o No meetings were held between Council and TfL as part of the
consultation process.

(10) What pre-consultation took place with interested parties to ensure
that the process was fair and balanced?

o There was no pre-consultation with Council to discuss a consultation
strategy for the Mayor's Transport Strategy.

(11) Does the council support a MTS consultation on the Draft Mayor of
London Transport Strategy that offers so little for the driver - private
motorist or professional driver of taxi, minicab, van, lorry or bus? How
important are private drivers in the overall use of transport in Croydon?
Has the council expressed concerns over this unfair and unbalanced aspect
of the consultation process?

o The Council has responded fully to the draft Transport Strategy.
Though we welcomed certain proposals within the strategy we have also
voiced concerns on a number of issues which we hope will be taken on
board when drafting the final Transport Strategy.

(12) Does the council support a MTS in which the promotion of cycling
within the draft MTS does not also include warnings on the dangers of this
mode? Does the council support the proposition that a mass switch to
cycling would be beneficial justified, and on what evidence?

o See reply to question 11 above.

(13) Does the council support a MTS consultation in which costings of
various suggestions were not put forward, so that the public could see how
much tax each would entail?

o See reply to question 11 above.

(14) Does the council support a MTS consultation in which there was no
question on the level of subsidy that each mode should receive?

o See reply to question 11 above.

(15) Does the council support a MTS consultation in which no question is
asked as to whether the users of a mode should bear all, most, some or
whatever proportion of the costs of providing that mode?

o See reply to question 11 above.

(16) What representations has or will the council make regarding the
consultation process into the Draft MTS as a result of this enquiry or
otherwise?

o The Council has no plans presently to make representations to TfL
regarding the consultation process.

Section 21 of the Freedom of Information Act 2000 provides an exemption to
disclosure where the information requested is accessible by other means.
Where information has not been provided (questions 11 - 15) it considered
that this reasonably available at it is located on the Council's Website.
The Mayor of London's Transport Strategy was considered at a meeting of
the Council's Cabinet that was held on 18 January 2010 and the report for

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Croydon Borough
Council's handling of my FOI request 'Mayor of London Transport
Strategy - Consultation Process - Very few aware within LB
Croydon'.

In respect of Q1, please confirm whether the council undertook any
publicity, as per the question.

In respect of Q2 to Q5, please confirm, regardless of any actions
by TfL, whether the council has any knowledge of these matters, and
if so its extent.

In respect of Q7, please clarify and answer the questions. Either
the council is happy, or it is not happy. Perhaps it has no view on
the consultation because it is unaware of any aspect of it. If it
is aware of any aspects, then it can say where it is happy or not
happy with those aspects.

In respect of Q11 to Q15, please provide a copy of the council's
actual response to the MTS Consultation. I note that the report
mentioned refers to "form the basis of the reply to the Mayor of
London". I want to see the actual response that was submitted.

I have read this report, however this does not provide answers to
the direct questions actually asked.
Please provide a response to those questions, which addresses
whether the issues raised are ones which the council does or does
not believe are relevant to the MTS.

In respect of Q1-Q5 and Q7, it is clear that I am complaining that
the council did not answer the specific question.

In respect of Q11-Q15, I agree that this is asking for further
information.
This is of course information that the council could and arguably
should have provided - under its ยง16 duty to provide help and
assistance.

Nevertheless, so long as the requested information is now provided
promptly and by 28-2-10, it may not matter if it is not as a result
of an Internal Review.

I refer to your email below. I note that you have requested for an
internal review of the FOI response sent to you. A request for internal
review will be most appropriate where the requestor is complaining about
the FOI process and/or the information provided or withheld. However, I
note your email below is either requesting further information or
clarification of the initial response. In view of this I have taken the
liberty of asking colleagues in the relevant council department to provide
answers o your further request for information.

Please find below their comments.

Q 1 - Croydon Council did not undertake any publicity itself. As stated
in the original response, there was insufficient time for the Council to
conduct an external consultation exercise between the date of publication
of the strategy and the response deadline whilst still meeting the various
internal Council approval processes.

Q 2 - Croydon Council is not aware of any TfL publication explaining the
draft strategy and their consultation process.

Q 3 to 5 - As stated in the original response, it is assumed that TfL
would hold this information. The Council itself has no knowledge of
these matters.

Q 7 - As the Council is unaware of TfL's consultation process/strategy it
is not possible to comment on what steps were taken to inform interested
organisations.

The council did not scrutinise or consider the online questionnaire as it
chose to respond more fully on all the Transport Proposals. We believe
this option was available to all respondents.

Q11 to 15 - The Council's response to the Mayor's Draft Transport Strategy
can be accessed via the link below (please refer to Appendix 2).

Thank you for your reply, and for confirming the position regarding
Q1-Q5 +Q7.

I have read the report to Cabinet of 18-1-10, and the Minutes of
that meeting.
It appears that the response sent to the MTS consultation was a
compilation of Appendix 2 and parts, for example p31-32 of the main
Agenda item.

I wrote before

"In respect of Q11 to Q15, please provide a copy of the council's
actual response to the MTS Consultation. I note that the report
mentioned refers to "form the basis of the reply to the Mayor of
London". I want to see the actual response that was submitted.

I repeat this request once more.
