Malvern Hills AONB Designation Order
Robert Whittaker made this Freedom of Information request to Natural England
The request was successful.
From: Robert Whittaker
24 February 2010
Dear Natural England,
Under the Freedom of Information Act, I would like a copy of the
original designation order for the Malvern Hills Area of
Outstanding Natural Beauty, including the original maps showing the
boundary route.
(I understand that the order dates from prior to 1960, and that
crown copyright lapses 50 years after publication. Therefore there
should be no copyright issues with these documents.)
I would prefer an electronic copy if possible, but I would be happy
with a paper copy if not.
Many thanks,
Robert Whittaker

6 April 2010
Dear Sir/ Madam,
Many thanks for replying to my request. The information you
provided, and the form you provided it in was exactly what I was
looking for.
However, I am a bit confused by the statement regarding copyrights
in your letter of 6th April (ref RFI #677). Could you clarify
exactly what documents (if any) Natural England may be claiming
copyright over, the term(s) of any such copyrights, and the date(s)
on which they expire?
I would have thought that the simple reproductions you have made
for me do not qualify for any additional copyright, so the only
copyright rests in the original Designation Order documents. As a
legislative order, I would have expected the Designation Order to
be Crown Copyright, rather than under the copyright of Natural
England (or one of its predecessors). (Indeed, the map explicitly
states that it is under Crown Copyright.) My understanding is that
Crown Copyright on published material expires 50 years from the
date of publication. Therefore, if this is the case, then the
copyright in the Designation Order has expired and there can be no
restrictions on using the information therein.
I would be grateful if you could clarify this for me.
Yours sincerely,
Robert Whittaker
