Dear Sir or Madam,

Under the freedom of information act I would like to know numerical
statistics in order by year during the period of 1998 to 2008 (or
as far back as you can go without charging me) for the following;

1) how many children were taken into local authority care on
interim care orders and emergency protection orders under the
catagory of emotional harm during the above period ? i do not wish
you to include any children for any other catagories of harm/abuse.

2)Out of these children who were taken into care for emotional harm
how many of them were specifically for domestic violence between
their parents? again i do not wish you to include children who had
violence directed at them as that would fall into a different
catagory being physical abuse.

3)Out of these children who were put into care for domestic
violence how many were returned to family or extended family ?

4)Out of these how many children were put on full care orders?

5)of the children put on full care orders how many were adopted
during these periods.

Dear Angela

Further to your request for information detailed below, I have been
advised that the legal terms used in your request ie interim care orders
and emergency care orders are not terms used in Scots Law therefore we
do not hold information relating to these categories.

Do you require the Comhairle to provide the information held by the
authority which would come under similar orders under Scots Law or was
the request for English Authorities only?

I await your advice on the processing of your request.

My apologies, yes if you could provide my information request on
orders for emotional harm that is more appropriate to Scottish law.
Could you confirm that emotional harm is a catagory used in the
childrens act/child protection in Scotland please?

Dear Angela

I refer to your request for information detailed below.

Your request for information has been processed in accordance with the Act and relevant guidance.

I can confirm that no children were taken into the care of the Comhairle under the category of 'emotional harm' during the period requested therefore the Comhairle do not hold any information which falls within the terms of your request.

If you are dissatisfied with this response you can request the Comhairle to review this response to your request for information.  You have 40 days, from the date of receipt of this response, in which to lodge this requirement for review.  A request for review must be in writing, describe your original request and explain why are dissatisfied.  An application for review should be sent to the Chief Executive, Comhairle nan Eilean Siar, Council Offices, Stornoway, Isle of Lewis, HS1  2BW ([email address]).  A request for review lodged with the Chief Executive will be processed promptly and in any event within 20 working days of receipt.

Should you still remain dissatisfied after completion of the review process you may apply to the Scottish Information Commissioner, 10 Kinburn Castle, Doubledykes Road, St Andrews, Fife, K16  9BS, to establish whether your request for information has been processed in accordance with Part 1 of the Freedom of Information (Scotland) Act 2002.
