Longest wait for a remedy that is still on record

A Freedom of Information request to Local Government Ombudsmen by Pauline Nunn

The request was successful.

Pauline Nunn

23 July 2008

Dear Sir or Madam,

Out of those cases still on record what was/is the longest period
of time a complainant has had to wait for the remedy promised to
the Ombudsman by a Council or recommended by the Ombudsman (as a
result of a previous finding of maladministration by an Ombudsman)?

What was the reason for the delay?

Which Ombudsman/Ombudsmen were/are involved?

Clarification: from the published report date to the date the
promised/recommended remedy was supplied or for those still waiting
for the promised/recommended remedy from the report date to today's
date.

Yours faithfully,

Pauline Nunn

Dear Hilary Pook,

Will you please explain why our initial case was excluded? Initial
complaint submitted to LGO in June 1997, initial report published
during October 1998. Still waiting for the remedy promised by the
council as a result of the ombudsman's finding of
maladministration. By our calculation that is some 11 years, or 3
years longer than the case you quoted. What's going on?

Yours sincerely,

Pauline Nunn

Dear Ms Nunn

I am afraid I have too little information from you to identify your
case.
You will need to either provide me with the reference number or your
address.

There are no complaints registered from anyone of your name on our
system.

Dear Hilary Pook,

I refer you back to my Freedom of Information request. 'Out of
those cases still on record what was/is the longest period of time
a complainant has had to wait for the remedy promised to the
Ombudsman by a Council...'

If you had answered the question correctly you would have
identified the case I am referring to.

In the alternative, Just look for a complaint that my husband and I
submitted to the Ombudsman in June 1997 to the York office. The
Ombudsman produced a report in October 1998 and the Council
promised the then Ombudsman a remedy during January 1999. The
current Ombudsman is aware that we are still waiting for the
promised remedy to our 1997 complaint.

By my calculation that's 3 years longer than the case you quoted
and, as such, the longest case on record. Unless of course you have
you left out other cases.

Yours sincerely,

Pauline Nunn

Dear Ms Nunn

I have answered you FOI request correctly according to the records on
our database. I am not prepared to go into detail about individual cases
without more proof of identity. We have a duty to protect complainants'
personal data. As I mentioned before, we have no record of complaints
from anyone of your name on our database, and you have not given me your
husband's name.

If you have an issue with the way your complaint(s) have been dealt
with, you should contact whoever has been dealing with your complaint(s)
about this. It is not a Freedom of Information issue.

Yours sincerely

Dear Hilary Pook,

I accept you have answered my FOI request according to the records
on your database. It's just a shame the records on your database
are incomplete and as such not fit for the purpose.

As a result, I see no point in anyone submitting a Freedom of
Information request to the Local Government Ombudsman's office
whilst you rely on a database that is clearly incomplete and out of
date.

I naively thought that this was a Freedom of Information issue and
that's why I tried to bring it to your attention, however, I am
sorry if my attempt to do so has upset you. I now accept your
assurance that the inaccuracy of the database which you use to
supply Freedom of Information responses is not a Freedom of
Information issue and will try an alternative means of bringing
this problem to someone's attention.

Thank you for all the help you have given me up to now.

Yours sincerely,

Pauline Nunn
