Dear Sir or Madam,
Can you please confirm when the wording on the LLP letters was
ammended to reflect the Interpretation Act and deemed delivery when
calculating the '28 day window' in which payment at a reduced rate
is payable.
I understand that a recent Court case found that the previous 28
day calculation used by DVLA did not reflect the Law correctly.
As the Court decided that the case brought before them was
unenforceable, are DVLA still going to insist on bringing the older
cases to Court that are legally incorrect and therefore an abuse of
power ??

Dear Mr Shanks
Thank you for your e-mail of 20 November 2009 addressed to the Driver
and Vehicle Licensing Agency (DVLA).
You requested information under the terms of the Freedom of Information
Act 2000 (FOIA). However, having considered your request it falls
outside the FOIA and will be dealt with as “business as usual”.
Therefore, your request has been passed to the relevant department
within the Agency who will shortly provide a response.
I can advise that DVLA also has a complaint procedure, the detail of
which is provided in the attached leaflet entitled “Customer Service
Guide and what to do if things go wrong" (INS 101), should you wish to
escalate this issue at a future date.
