Please could you send me or tell me how to obtain a list of
properties or land in West Yorkshire that have no estate recorded,
that is to say that are not owned by anyone.

Dear Mr. Harston,

Thank you for your e-mail dated 26 November 2009 requesting a list of
properties or land in West Yorkshire that have no estate recorded, that is
to say that they are not owned by anyone. I am dealing with it under the
terms of the Freedom of Information Act 2000.

Please note that Land Registry's business is to register ownership of land
in England and Wales and to record dealings with registered land once it
is registered. As we are responsible for maintaining the register to
registered land we do not hold details of the unregistered land, in
England and Wales. Therefore I am unable to provide a list of properties
or land in West Yorkshire that is not registered. However, we are able to
confirm that around 81.58% of the land in West Yorkshire is registered and
18.42% remains unregistered. You can access this information from our main
website at www.landregistry.gov.uk <[1]http://www.landregistry.gov.uk> by
clicking on Registering your land - how much land in your area is
registered then choosing from the link how you want your data to be
displayed (i.e. in table format or by county from the given map).

Under section 21 of the Act, we are not required to provide information in
response to a request if it is already reasonably accessible to you by
other means.

If your enquiry is in respect of specific land then you may be able to
ascertain whether it is registered or not by carrying out a Search of the
Index Map. I refer you to Practice Guide 10, which provides guidance. This
can be downloaded from our main Land Registry Website
<[2]http://www.landregistry.gov.uk>. This information is available under
the Land Registration Act 2002 and Rules 2003 and therefore reasonably
accessible by other means. This would therefore not be a Freedom of
information request under the Act.
