List of council owned residential properties

Please supply me with an electronic list of all residential properties (occupied or unoccupied), owned by the Council. I do not want to identify empty properties and I do not want to recieve any personal data about the occupants. The list should just identify the street name and number of any residential property owned by the authority.

I am happy to consider any request for clarification or to discuss any means by which your compliance with this request may be made as easy as possible.

I am writing to request an internal review of Manchester City Council's handling of my FOI request 'List of council owned residential properties'.

In respect of your application of the exemption for personal data (S40), I would refer you to the Information Commissioner's decision in respect of Braintree District Council (refFS50066606 3 Jan 2007). That decision related to an identical information request and the ICO held that the S40 exemption did not apply.

The remainder of your letter relates to a request to obtain data on unoccupied properties. My request does not seek such data and if answered correctly, the information would be incapable of identifying empty properties. These exemptions are irrelevant.

I note that you have waited until the very last day of the 20 day period before informing me of the application of these exemptions. I also note that a good part of the letter appears to have been cut and pasted from previous responses. The perception given is that you have deliberately waited the full 20 days as some form of obstructive tactic.

I would be grateful for a speedier response to my request for a review.

This seems to have passed the appropriate 20 day review period.

Dear Ms Cryer,
I have not received a response to my request for an internal review. The Information Commissioner's guidance suggests a response within 20 working days. You acknowledged my request on 19 April and this timescale has therefore been exceeded.

I cannot avoid the conclusion that you are deliberately seeking to delay this request. Unless, I receive a clear timescale for dealing with my request from you within the next 2 days, I will lodge a complaint with the Information Commissioner.

It has come to our attention that there is a referencing error in the
letter that was sent to you by the Council on 2 June 2010. The second
reference that is made in this letter to the House of Commonscase wrongly
states that this was upheld by "the Court of Appeal" on 16 May 2008. The
House of Commonscase was in fact upheld by the High Court (as stated in our
first reference at point 2 of the paragraph setting out the issues
considered by the Council on Internal Review) and not the Court of Appeal.

The Council apologises for any confusion that this may have caused, and
sets out below the full reference to the case concerned so that there is no
uncertainty as to the Court that was involved: Corporate Officer of the
House of Commons v The Information Commissioner, Heather Brooke, Ben
Leapman, Jonathan Michael Ungoed-Thomas (Case No: CO2888/2008 High Court of
Justice Divisional Court 16 May 2008) [2008] EWHC 1084 (Admin).
