Please can you provide me with the following information under the
Freedom Of Information Act 2000:-
(a) addresses and rateable values of Commercial properties that are
within your District Council up to a rateable value of £12,000 who
are eligible for, but not currently receiving small business rate
relief; and
(b) the names of the owners of those properties referred to in (a)

Dear Mr Woodley,
Thank you for your request for information, received on the 2nd January
2010.
You have requested that we provide:
a) addresses and rateable values of commercial properties that are within
the City Council's district up to a rateable value of £12,000 who are
eligible for, but not currently receiving small business rate relief.
b) the names and address of the owners of those properties referred to in
(a).
I have attached a list of properties, with a rateable value up to
£12,000, who are not currently in receipt of small business rate relief
(SBRR). It is not possible to confirm whether or not these ratepayers are
eligible for SBRR, as this cannot be fully ascertained until a completed
application form is received.
Please note that this list does not include details of those properties
occupied by individuals. I would consider that the Council would not be
able to disclose personal information relating to private individuals as
personal information about their identity and financial affairs is
protected under the absolute exemption provided by Section 40(2) of the
Freedom of Information Act 2000. This exemption applies where the
disclosure of the information, so far as it comprises personal information
about individuals, would contravene one or more of the data protection
principles under the Data Protection Act 1998, including the principle
that information should be processed fairly and lawfully. Without the
consent of an individual ratepayer I do not consider that the release of
this information into the public domain under FOIA could be justified
under any of the processing conditions provided under Schedule 2 of the
Data Protection Act.
If you are not happy with this response please contact Tracey Hurst, by
emailing [1][email address], in the first instance. If you are
still not satisfied you have the right to ask for an internal review of
the decision. This will be dealt with by the Head of Legal and Human
Resources. If your appeal is not resolved you would then have the further
right to appeal to the Information Commissioner for an independent review.
